Abstract

Each country has a national interest that can be obtained from the use of natural resources, especially natural resources in the sea. For this interest, having a larger maritime territorial area and Economic Exclusive Zone will certainly benefit the country that owns the area. The large profits that have the potential to benefit the state make the state want to control more territory, which leads to create disputes between countries regarding claims to the state's maritime territory. One of the cases related to this sea area is the one between Somalia and Kenya. This dispute relates to the maritime boundary of 160,000 KM2 in the Indian Ocean region, where Somalia is suing Kenya through the International Court of Justice. This study will discuss the arrangement of the distribution of maritime natural resources in the border areas of Somali and Kenya in accordance with the provisions of UNCLOS 1982 and how the process of resolving maritime border disputes between Somalia and Kenya according to the provisions of International Law and UNCLOS 1982. This research is a juridical-normative research, by using secondary data types, namely primary and secondary legal materials. The approach taken is a case law approach.
