Penelitian ini membahas tentang Tinjauan Yuridis Penyelesaian Perkara Pidana Oleh Anak Berdasarkan Hukum Adat Dan Prinsip Restorative Justice. Permasalahan pada penelitian ini terletak pada penerapan Restorative Justice dan Diversi pada anak yang berhadapan dengan hukum (ABH). Penelitian ini menggunakan metode penelitian Yuridis Normatif, dengan pendekatan peraturan perundang-undangan, pendekatan konsep, dan pendekatan kasus, serta pengolahan bahan hukum yang dilakukan secara studi pustaka. Berdasarkan Pasal 1 ayat 3 UU 11/2012 Anak yang berhadapan dengan hukum haruslah mendapatkan hak-hak dan perlindungan baik itu pelaku tindak pidana, korban tindak pidana maupun saksi dengan diupayakannya Pasal 1 butir (7) UU 11/2012 yaitu Diversi atau penyelesaian perkara diluar pengadilan agar terpenuhinya Restorative Justice dalam Pasal 1 angka 6 UU 11/2012, dengan mendepankan pemulihan bukan balas dendam. Kesimpulan pada penelitian ini adalah penyelesaian perkara diluar pengadilan yaitu diversi harus dengan Restorative Justice yang mengedepankan masa depan pelaku tindak pidana, korban, dan pihak yang terlibat. / This research discusses the Juridical Review of the Settlement of Criminal Cases by Children Based on Customary Law and the Principles of Restorative Justice. The problem in this study lies in the application of Restorative Justice and Diversion to children in conflict with the law (ABH). This study uses a normative juridical research method, with an approach to legislation, a concept approach, and a case approach, as well as processing legal materials carried out by means of a literature study. Based on Article 1 paragraph 3 of Law 11/2012, children who are in conflict with the law must have rights and protection whether they are perpetrators of crimes, victims of criminal acts or witnesses. By pursuing Article 1 point (7) of Law 11/2012, namely Diversion or settlement of cases outside the court to fulfill Restorative Justice in Article 1 number 6 of Law 11/2012 prioritizing recovery not revenge, the conclusion in this study is that the settlement of cases outside the court namely diversion must be with Restorative Justice which prioritizes the future of the perpetrators of crimes, victims, and parties involved.
