Children born as a result of incestuous marriages are often debated about their legal status and protection according to Islamic law and Law Number 1 of 1974 concerning Marriage. This study aims to determine the legal status and protection for children due to inbreeding according to Islamic law and Law Number 1 of 1974 concerning Marriage. The formulation of the problems studied are: 1. What is the legal status of children born as a result of incest or incest according to Islamic law and Law Number 1 of 1974? 2. What is the legal protection for children due to incest or incest according to Islamic law and Law Number 1 of 1974?. This research is a normative legal research. The type of research used is qualitative. Data collection in this study used secondary, primary and tertiary data. The type of data used is through a literature study of the applicable laws and also interviews with MUI scholars and legal consultants in the civil sector. Based on the results of this study, it can be concluded that the legal status of children due to inbreeding is in accordance with Article 100 of the Compilation of Islamic Law, then the legal status of children due to inbreeding is according to Article 43 of Law Number 1 of 1974 concerning marriage. Then in terms of legal protection for children due to inbreeding, it is contained in Article 75 and Article 76 of the Compilation of Islamic Law. Then Article 45 of Law Number 1 of 1974 concerning Marriage.
