Abstract

The fishing industry is an industry that has very high potential. The use of the sea by the community can certainly harm the surrounding environment. Although there are regulations that regulate Chemical waste (B3), business actors often ignore the regulations regarding B3 waste. This study aims to determine the regulation of B3 waste and to find out the real practice of fishing companies in Maluku. To answer this, a normative research method has been carried out where the research is carried out by comparing legal and social facts, and empirical research is conducted to analyze the workings of law in society. The type of data used in this research is primary legal materials. The conclusion obtained is that the Regulation on the Environment is regulated in Law 32 of 2009 concerning Environmental Processing and Protection and Government Regulation 101 of 2014 as a derivative regulation. Marine regulations are regulated in Law 32 of 2014 concerning marine affairs and regulations regarding fisheries are regulated in Law 45 of 2009. From the results of research conducted, fishing companies generally do not focus on B3 waste treatment. Generally, fishing companies only focus on selling fish such as export activities and marketing activities. This happens because fishing companies are capital-intensive businesses so it is not possible to treat their waste.
