Abstract

Indonesia has abundant mineral and coal reserves. As the largest coal-producing country in the world, the Government of Indonesia certainly needs to establish a licensing regulation in the context of orderly administration and provide a restriction in mineral and coal mining with the provisions of providing legal protection and creating order in the implementation of mining in Indonesia. The dynamics of coal mining licensing policies have caused controversy because on the one hand, energy needs still require coal as a source, but on the other hand, the current global trend is to stop the use of fossil energy, including coal. This research uses normative juridical methods and field research through interviews. The conclusion is that Indonesia's national policies to date still support coal as a potential source of government revenue from the non-tax sector. This policy is illustrated by the shift in the legal norms for coal mining licensing which shifted from a contract regime to a permit regime in accordance with Law no. 3 of 2020 concerning Amendments to Law No. 4 of 2009 concerning Mineral and Coal Mining. The government seeks to synchronize and collaborate with various implementing regulations, especially those relating to cross-ministerial and/or institutional arrangements.
