Abstract

The creation of Association of Southeast Asian Nations (ASEAN) encourages the cooperation of the ASEAN Community (ASEAN Community) in the service sector which is contained in the ASEAN Framework Agreement on Services (AFAS). In order to facilitate AFAS, it requires recognition between countries called the Mutual Recognition Arrangement (MRA). Dentist becomes one of the profession included in the service sector. This is included in the ASEAN MRA document on Dental Practitioners in order to facilitate dentists amongst South East Asian countries. However, the integration of dentist in each nation still have to go by the domestic regulation and follow the national interest of every nation state. This becomes a big question when Indonesia is the only country that does not allow foreign dentists to practice freely in accordance with medical practice laws. This study will use qualitative theory using the concept of neoliberalism, regionalism, national interest, sovereignty, and the understanding of international organizations in regionalism to explore the regulation of dentist registration in Indonesia. The result of this study prove how ASEAN applies their integration model in the field of the dental profession in order to achieve general interest. The ASEAN integration that we know of today, does not appear like integration in other regions. Other findings also proved that the integration tries to fulfil and follow nation state’s interest. / Terciptanya kawasan Asia Tenggara bernama Associatian of South East Asian Nations (ASEAN) mendorong kerja sama Komunitas ASEAN (ASEAN Community) dalam sektor jasa yang tertuang dalam ASEAN Framework Agreement on Services. Agar kerangka AFAS dapat berjalan dengan baik diperlukan adanya pengakuan antara negara-negara yang disebut Mutual Recognition Arrangement (MRA). Dalam hal ini dokter gigi menjadi profesi yang termasuk ke dalam sektor jasa. Hal ini tercakup dalam dokumen ASEAN MRA on Dental Practitioners agar profesi dokter gigi dapat memfasilitasi dokter gigi. Namun integrasi dokter gigi masih menghormati regulasi domestik yang berlaku serta mengikuti kepentingan nasional dari masing-masing negara. Hal ini menjadi pertanyaan besar ketika Indonesia menjadi satu-satunya negara yang tidak mengizinkan dokter gigi asing berpraktik dengan bebas menurut undang-undang praktik kedokteran. Penelitian ini akan menggunakan metodologi kualitatif serta menggunakan teori neoliberalisme, regionalisme, kepentingan nasional, dan pemahaman mengenai organisasi internasional dalam regionalisme untuk mendalami pengaturan regulasi dokter gigi di Indonesia. Hasil penelitian ini mengkonfirmasi bagaimana ASEAN melaksanakan model integrasi regional terutama dalam integrasi profesi dokter gigi yang berupaya menjunjung tinggi kepentingan umum. Integrasi ASEAN yang kita ketahui hari ini, tidak mengacu pada integrasi penuh yang dilaksanakan layaknya integrasi di kawasan regional lainnya. Fakta lain yang ditemukan adalah integrasi yang ada berusaha untuk memenuhi dan mengikuti kepentingan nasional suatu negara.
