Abstract

Terdapat 2 (dua) pengaturan yang berbeda dalam Peraturan Pemerintah Nomor 18 Tahun 2021 dan Peraturan Menteri ATR BPN Nomor 18 Tahun 2021 terkait jangka waktu pengajuan permohonan perpanjangan Hak Guna Bangunan. Tujuan penelitian ini untuk mengetahui dan menganalisis kekuatan hukum pemegang sertifikat hak guna bangunan yang habis masa berlakunya dan kekuatan hukum perubahan hak atas tanah yang semula sertifikat hak guna bangunan yang masa berlakunya telah berakhir menjadi sertifikat hak milik. Dalam menganalisis, penulis menggunakan 2 (dua) pendekatan yaitu pendekatan konseptual dan pendekatan undang-undang. Diketahui, ternyata pemegang Hak Guna Bangunan dapat mengajukan permohonan perpanjangan atau pembaruan Hak Guna Bangunan jika syarat-syaratnya terpenuhi. Sekalipun hubungan subjek dengan hak atas tanah telah berakhir, tetapi hubungan subjek dengan pemilikan dan penguasaan tanah tidak langsung berakhir. Adanya inkonsistensi mengenai jangka waktu Hak Guna Bangunan. Artinya, meskipun telah lewat 2 (dua) tahun setelah berakhirnya jangka waktu Hak Guna Bangunan, pemegang hak tetap dapat mengajukan permohonan perpanjangan Hak Guna Bangunan. Saran penelitian ini yaitu (1) Perlu memperhatikan kepastian hukum bagi mantan pemegang hak guna bangunan mengenai kejelasan hubungan subyek dengan tanah, dan hubungan subyek dengan pemilikan dan penguasaan tanah. (2) Perlu dilakukan perubahan terhadap PP Nomor 18 Tahun 2021 dan Peraturan ATR 18 Tahun 2021 menjadi PP Nomor 18 Tahun 2001 tentang Perpanjangan Jangka Waktu Hak Guna Bangunan. / There are 2 (two) different arrangements in Government Regulation No. 18 of 2021 and Ministerial Regulation of ATR BPN No. 18 of 2021 related to the period for submitting an application for an extension of Rights to Build . The purpose of this study is to find out and analyze the legal force of the holder of the certificate of rights to build whose term has expired and the legal force of changes to property rights which were originally certificates of building use rights whose period has expired become certificates of property rights. In analyzing, the author uses 2 (two) approaches which are conceptual approach and statute approach. Found out, it appears that the holder of the Rights to Build can apply for an extension or renewal of the Rights to Build if the conditions are met. Even if the subject's relationship with land rights has ended, but the subject's relationship with land ownership and control does not necessarily end. It can be seen that there are inconsistencies regarding the term of this period Rights to Build. This means that even though 2 (two) years have passed after the expiry of the term of the Right to Build, the right holder can still apply for an extension of the Right to Build. Suggestions in this study are (1) It is necessary to pay attention to legal certainty for former holders of building rights regarding the clarity of the subject's relationship with the land, and the subject's relationship with the ownership and control of the land. (2) It is necessary to make changes to PP Number 18 of 2021 and the ATR Regulation 18 of 2021 to PP No. 18 of 2001 regarding the extension period of Rights to Build.
