Abstract

Berlakunya Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris (UUJN) Pasal 20, melahirkan perkembangan hukum dibidang kenotariatan yaitu kerja sama Notaris dalam bentuk Perserikatan Perdata. Menindaklanjuti Pasal 20 ayat (3) UUJN, dikeluarkan Peraturan Menteri Hukum dan Hak Asasi Manusia Republik Indonesia Nomor M.HH.01.02.12 Tahun 2010 tentang Persyaratan Menjalankan Jabatan Notaris Dalam Bentuk Perserikatan Perdata. Selanjutnya dengan diundangkan Undang-Undang Nomor 2 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris menghapus Pasal 20 ayat (3) UUJN menimbulkan akibat hukum dihapusnya Peraturan Menteri tersebut diatas. Pasal 20 UUJN Nomor 2 Tahun 2014 tidak memberikan definisi Persekutuan Perdata. Melihat latar belakang tersebut, terdapat permasalahan yaitu bagaimana eksistensi perjanjian kerja sama dalam Persekutuan Perdata dan apakah prinsip kemandirian dan kerahasiaan Notaris dalam menjalankan jabatannya dapat terpenuhi. Untuk menjawab permasalahan, Penulis melakukan penelitian dengan menggunakan metode normatif yang hasilnya bahwa eksistensi perjanjian kerja sama Persekutuan Perdata tidak efektif karena bertentangan dengan pelaksanaan jabatan Notaris. Persekutuan Perdata mengacu pada KUHPerdata bertujuan mencari keuntungan sedangkan pelaksanaan jabatan Notaris adalah untuk pengabdian kepada masyarakat dan negara. Prinsip kemandirian dan kerahasiaan Notaris dalam menjalankan jabatannya, tidak terpenuhi karena Notaris melibatkan rekan Notaris dalam pembuatan akta sehingga tidak mandiri dan sulit mempertahankan kerahasiaan dalam menjalankan jabatannya / The enforcement of Law Number 30 of 2004 on Notary Position has introduced legal development of notary in the form of civil partnership agreement. In furtherance of Article 20 paragraph (3) Notary Law, there was issued Minister of Law and Human Rights of the Republic of Indonesia Regulation Number M.HH.01.02.12 of 2010 on Requirements for Notary Position in the form of a Civil Partnership. Further, the promulgation of Law Number 2 of 2014 on Amendment to Law Number 30 of 2004 on Notary Position superseding Article 20 paragraph (3) of Law of Notary Position results in abolition of the Minister’s Regulation above. The Article 20 and Explanation to Article 20 of Notary Law No. 2 of 2014 does not provide clear definition of Civil partnership. Looking at this background, there are issues as to how the existence of partnership agreement in the civil partnership and whether principle of independence and privacy of Notary in the exercise of his position can be fulfilled. To answer this issue, the author conducted the research by applying normative method. It was concluded that the existence of partnership agreement in the Civil partnership is ineffective since Notary entering into Notary Agreement as defined in Article 20 Notary Law Number 2 of 2014 is inconsistent with the service of Notary, in essence, the forming of civil partnership previously defined in Civil Code was to seek advantage whilst the service of a Notary is a matter of dedication to the public and country. Both principles of independency and privacy cannot be fulfilled given that Notary, in the exercise of the position, mostly involve the role of partners in the preparation of notarial deed which results in dependence and difficulty to maintain privacy in the exercise of his position
