Abstract

Perkembangan kebutuhan kredit di masyarakat khususnya untuk sektor usaha mikro, kecil dan menengah semakin meningkat. Oleh karenanya bank membuat program kredit yang semakin memudahkan masyarakat dalam meminjam uang. Salah satunya program kredit umum pedesaan (KUPEDES) yang menawarkan syarat agunan tidak bersertifikat salah satunya dengan bukti penguasaan berupa surat pernyataan pelepasan hak Atas Tanah (SPPHAT). Hal ini banyak menimbulkan konflik hukum di masyarakat. Faktor penyebab utamanya karena tidak adanya ketentuan hukum perihal pembebanan agunan berupa SPPHAT. Oleh karena itu diperlukan penelitian agar kekuatan hukum SPPHAT sebagai agunan dalam kredit memiliki kepastian dan perlindungan hukum. Penelitian ini dilakukan secara normatif empiris dengan pendekatan kasus, undang-undang dan konseptual. Dari Penelitian ini disimpulkan bahwa secara hukum pertanahan, Status Tanah dengan bukti SPPHAT merupakan tanah negara. Oleh karenanya, masih diperlukan upaya proses permohonan hak atas tanah dan pendaftaran tanah. Sehingga terbit sertifikat tanah sebagai bukti kepemilikan atas tanah. Perjanjian kredit dengan agunan berupa SPPHAT tidak memiliki kekuatan hukum. Sehingga menjadikan kedudukan kreditur secara hukum hanya menjadi kreditur konkuren/The development of credit needs in the community, especially for the micro, small and medium business sector is increasing. Therefore, banks create credit programs that make it easier for people to borrow money. One of them is the rural general credit program (KUPEDES) which offers uncertified Collateral, one of them by proof the ownership in the form of a relinquishment of land rights (SPPHAT). This causes many legal conflicts in society. The main contributing factor is the absence of legal provisions regarding the imposition of collateral in the form of SPPHAT. Therefore, research is needed so the legal position of SPPHAT as collateral in credit has legal certainty and protection. This research was carried out in an empirical normative manner with a case, law, and conceptual approach. From this research, it is concluded that according to agrarian law, a land status with proof the ownership of SPPHAT is state land. Therefore, still need a process for land rights application and land registration. So, that a land certificates is issued as proof of land rights ownership. Credit agreements with collateral in the form of SPPHAT do not have the same legal force as credit agreements with special guarantees. So, the legal position of the creditor is only a concurrent creditor.
