Abstract

Pengadaan Tanah untuk Kepentingan Umum merupakan cara pemerintah atau negara apabila ingin mengambilalih tanah yang hak atas tanahnya telah dimiliki oleh masyarakat pada saat melaksanakan pembangunan nasional seperti pembangungan infrastruktur jalan lingkar utara (JLU) di kota cilegon. Pemerintah kota cilegon dalam pembangunan infrastruktur jalan tersebut memiliki peran yang sangat penting. Namun dalam Pengadaan Tanah untuk Kepentingan Umum ini tidak hanya pemerintah kota cilegon saja yang memiliki peran, terdapat instansi lain yang memiliki peran pada saat pengadaan tanah untuk kepentingan umum, salah satunya adalah kantor Pertanahan Kota Cilegon, namun peran tersebut memiliki batasan-batasan sebagaimana telah diatur di dalam suatu peraturan yang berlaku. Namun pada prakteknya hingga saat ini masih banyak masyarakat beranggapan bahwa seluruh kegiatan yang ada hubungannya dengan tanah yang memiliki kewenangan, kebijakan, dan keputusan ialah kantor pertanahan kota cilegon. Penelitian ini bertujuan untuk mengetahui peran kantor pertanahan kota cilegon dalam pengadaan tanah untuk kepentingan umum tersebut dengan menggunakan pendekatan terhadap peraturan terkait dan hasil survei langsung ke instansi terkait. Pada akhirnya dapat disimpulkan bahwa peran kantor pertanahan kota cilegon dalam pengadaan tanah untuk kepentingan umum tersebut ialah hanya sebagai pelaksana yang turun langsung ke lapangan untuk melakukan survei tematik dan mengumpulkan data yuridis yang diperoleh dari masyarakat./Land Procurement for Public Interest is a way for the government or the state if they want to take over land whose land rights have been owned by the community when carrying out national development such as the construction of the northern ring road infrastructure in the city of Cilegon. Cilegon city government in the development of road infrastructure has a very important role. However, in this Land Procurement for Public Interest, not only the Cilegon city government has a role, there are other agencies that have a role in land acquisition for the public interest, one of which is the Cilegon City Land office, but this role has limitations as regulated in an applicable regulation. However, in practice, until now there are still many people who think that all activities related to land that have authority, policies, and decisions are the land office of the city of Cilegon. This study aims to determine the role of the Cilegon city land office in land acquisition for the public interest by using an approach to related regulations and the results of direct surveys to related agencies. In the end, it can be concluded that the role of the Cilegon city land office in land acquisition for the public interest is only as an executor who goes directly to the field to conduct thematic surveys and collect juridical data obtained from the community.
