Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional teleh mengeluarkan kebijakan mengenai Hak Guna Usaha Nomor 7 Tahun 2017 tentang Pengaturan dan Tata Cara Penetapan Hak Guna Usaha. Untuk mengetahui keselarasan peraturan tersebut dengan peraturan lainnya khususnya dengan Undang-Undang Nomor 4 Tahun 1996 tentang Hak Tanggungan Atas Tanah Beserta Benda-Benda Yang Berkaitan Dengan Tanah, dalam hal eksekusi Hak Tanggungan melalui proses lelang agunan yang dilakukan oleh kreditur pemegang Hak Tanggungan dengan objek jaminan Hak Guna Usaha pada saat debitur cidera janji, perlu dilakukan penelitian mengenai keselarasan dan perlindungan hukum bagi kreditur pemegang Hak Tanggungan dengan objek jaminan Hak Guna Usaha. Dari hasil penelitian tersebut, dapat disimpulkan bahwa terdapat ketidakselarasan antara Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 7 Tahun 2017 tentang Pengaturan dan Tata Cara Penetapan Hak Guna Usaha dengan Undang-Undang Nomor 4 Tahun 1996 tentang Hak Tanggungan Atas Tanah Beserta Benda-Benda Yang Berkaitan Dengan Tanah, sehingga belum dapat sepenuhnya menjamin perlindungan hukum bagi kreditur pemegang Hak Tanggungan dengan objek jaminan berupa Hak Guna Usaha / The Minister of Agrarian and Spatial Planning / Head of the National Land Agency have issued a policy regarding the Right to Cultivate Number 7 of 2017 concerning the Arrangement and Procedure for Determining the Right to Cultivate. In the aims of finding out the alignment of these regulations with other regulations, especially Law Number 4 of 1996 concerning Mortgage Rights and Objects Related to Land, in the case of execution of Mortgage through the collateral auction process carried out by the creditor as the Mortgagee with the object of collateral of The Right to Cultivate in the event of defaulting debtor, it is necessary to conduct a research on the alignment and legal protection for creditors as the Mortgagee withcollateral of The Right to Cultivate. From the results of this study, it can be concluded that there is a misalignment between the Regulation of the Minister of Agrarian and Spatial Planning / Head of the National Land Agency Number 7 of 2017 concerning the Arrangement and Procedure for Determining theRight toCultivate with Law Number 4 of 1996 concerning Mortgage Rights and Objects Related to Land so as it has not been able to fully guarantee the legal protection for creditors as the Mortgagee with the object of collateral of The Right to Cultivate
