Abstract

"Banyaknya perusahaan investasi yang muncul membuktikan bahwasanya perkembangan investasi semakin pesat, hanya saja tidak sedikit perusahan investasi yang melakukan penipuan. Di Indonesia sendiri sudah banyak kasus penipuan investasi yang memakan banyak korban. Penelitian ini bersifat yuridis normatif adalah pendekatan yang dilakukan berdasarkan bahan hukum utama dengan cara menelaah teori-teori, konsep-konsep, asas-asas hukum serta peraturan perundang-undangan yang berhubungan dengan penelitian ini. Penelitian ini dikenal pula dengan pendekatan kepustakaan, yakni dengan mempelajari buku-buku, peraturan perundang-undangan dan dokumen lain yang berhubungan dengan penelitin ini. Dalam penelitian ini pengumpulan data dikumpulkan dengan cara mewawancarai notaris, investor dan perusahaan investasi sebagai unsur-unsur yang memenuhi syarat. Dari hasil penelitian tersebut dapat disimpulkan bahwa perjanjian tetap sah//berlaku sesuai Pasal 1320 KUHPer karena antara dua pihak saling menyetujui meskipun ditengah jalan adanya wanprestasi dari salah satu pihak, dan notaris memiliki peran yang tidak langsung dalam mencegah maraknya penipuan investasi tersebut karena memiliki fungsi dan jabatan yang diberikan kewenangan oleh UU Jabatan Notaris untuk membuat akta pendirian perusahaan dan kemudian membantu perusahaan investasi membuat kontrak atau kerjasama dengan pihak lain"/" The number of investment companies that have emerged proves that investment development is growing rapidly, it's just that not a few investment companies commit fraud. In Indonesia, there have been many cases of investments fraud that took many victims. This research is juridical normative is an approach that is based on the main legal material by examining theories, concepts, legal principles and laws and regulations related to this research. This research is also known as the library approach, namely by studying books, laws and regulations and other documents related to this research.In this study, data was collected by interviewing notaries, investors and investment companies as elements that meet the requirements. From the results of this study, it can be concluded that the agreement remains valid in accordance with Article 1320 of the Criminal Code because the two parties agree to each other even though there is a default from one of the parties, and the role of the notary is very important (indirect roles) in preventing the rise of fraudulent investment companies because they have functions and positions which is given the authority by the Law on the Position of a Notary for such establish the company deeds and make some contract with other parties"
