Abstract

Tesis ini membahas kasus mengenai Bank yang memberikan kredit dengan jaminan tanah. Bank mencairkan kredit kepada Debitur hanya berdasarkan Cover Note/Surat Keterangan Notaris. Cover Note yang dikeluarkan Notaris hanya untuk menjembatani dokumen-dokumen perjanjian kredit yang salinan aktanya serta dokumen jaminannya belum dapat diselesaikan pada saat itu. Seiring berjalannya waktu, Debitur wansprestasi sehingga terjadi kredit macet. Bank bermaksud mengeksekusi Hak Guna Bangunan/Obyek Hak Tanggungan Peringkat 1 (HT-I) untuk melunasi hutang Debitur. Ternyata jangka waktu Sertipikat Hak Guna Bangunan (SHGB) milik Debitur telah berakhir sehingga HT-I menjadi tidak berlaku. Hal tersebut terjadi akibat kelalaian Debitur dan Bank dalam menganggarkan dana untuk perpanjangan SHGB. Sehingga Notaris tidak dapat memperpanjang SHGB sebagaimana tertulis dalam Cover Note. Cover Note hanya merupakan Surat Keterangan dan bukan dokumen resmi syarat pencairan kredit. Sehingga dalam kasus ini Notaris turut menjadi terdakwa dan mendapat tuntutan pidana, walaupun yang bertanggung jawab seharusnya Bank dan Debitur. Penelitian ini dilakukan dengan metode Penelitian Yuridis Normatif / This thesis discusses the case regarding a bank that provides loans with the land as collateral. The bank disburses credit to the Debtor based solely on the Cover Note/ Notary Certificate. Cover Note issued by a Notary is only to bridge the credit agreement documents which copy of the deed and the guarantee documents cannot be completed at that time. As time went on, and loans become bogged down. The Bank intends to execute Building Rights/Objects of Rank 1 Mortgage Rights (HT-I) to pay off debtors' debts. It turned out that the Sertipikat Hak GunaBangunan (SHGB) period had expired so that HT-I became invalid. This happened due to the negligence of the Debtor and the Bank in budgeting funds for the extension of the SHGB. So that the Notary cannot extend the SHGB as stated in the Cover Note. Cover Note is only a Certificate and is not an official document for credit disbursement requirements. So in this case the Notary also became a defendant and received criminal charges, even though the responsibility was supposed to be on the Bank and the Debtor. This research was conducted by the Normative Juridical Research method
