Nowadays, land that has been possessed by land rights holder out of neglected land, it’s mean that the land is being abandoned or there is an element of intention conduct of non-use in accordance with the circumstances or the nature and purpose of his rights. UUPA provides a provision that every land rights granted or obtained from the state (Ownership Rights, HGU, HGB) are deleted if abandoned. Meaning, if But in reality there are still problems where the emergence of abandoned land is caused by an error in the designation of abandoned land carried out by the Land Agency, that is, not through procedures determined by legislation. This research are normative juridical research or doctrinal law research because this research intended only on written rules of regulation or other legal material. This study uses secondary data based, which is data that supports information or supports the completeness of primary data obtained from library. The method of approach is carried out by examining all laws and regulations relating to the legal issues. The results of the study indicate that the procedures for establishing abandoned land that are not attended by holders of land rights, the determination of the land is not in accordance with the provisions of the law and will be able to canceled if the holder of the land rights demands. Decision of the Supreme Court Judge in Decision No. 409 K / TUN / 2014 is not in accordance with the provisions of Article 7 paragraph (1) letter (c) of Government Regulation Number 11 of 2010 concerning Control and Utilization of Neglected Land jo. Article 8 paragraph (2) letter (c) Head of BPN Regulation No. 4 of 2010. / Saat ini tanah yang telah dikuasai dan atau dimiliki oleh pemegang hak atas tanah dibeberapa tempat masih banyak dalam keadaan terlantar, yaitu tanah tersebut dibiarkan terbengkalai atau tanah tersebut tidak dipergunakan sesuai dengan keadaannya atau sifat dan tujuan haknya. UUPA memberikan ketentuan bahwa setiap hak atas tanah yang diberikan atau diperoleh dari negara (Hak Milik, HGU, HGB) hapus apabila ditelantarkan. Namun pada kenyataannya masih ada permasalahan dimana timbulnya tanah terlantar disebabkan oleh kesalahan dalam penetapan tanah terlantar oleh Badan Pertanahan, yakni tidak melalui prosedur yang ditentukan perundang-undangan. Penelitian ini merupakan jenis penelitian yuridis normatif atau penelitian hukum doktriner karena penelitian ini dilakukan atau ditujukan hanya pada peraturan peraturan yang tertulis atau bahan bahan hukum lainnya. Data dalam penelitian ini menggunakan data sekunder, yaitu : data yang mendukung keterangan atau menunjang kelengkapan data primer yang diperoleh dari perpustakaan. Metode pendekatan dilakukan dengan menelaah semua undang-undang dan regulasi yang bersangkut paut dengan isu hukum yang sedang ditangani. Hasil penelitian menunjukkan bahwa prosedur penetapan tanah terlantar yang tidak dihadiri oleh pemegang hak atas tanah atau pihak yang diberi kuasa, maka penetapan tanah tersebut tidak sesuai ketentuan perundang-undangan dan dapat dibatalkan apabila terjadi penuntutan oleh pemegang hak atas tanah yang bersangkutan. Putusan Majelis Hakim Mahkamah Agung dalam Putusan No. 409 K/TUN/2014 tidak sesuai dengan ketentuan Pasal 7 ayat (1) huruf (c) Peraturan Pemerintah Nomor 11 Tahun 2010 tentang Penertiban dan Pendayagunaan Tanah Terlantar jo. Pasal 8 ayat (2) huruf (c) Peraturan Kepala BPN No. 4 Tahun 2010.
