Abstract
Perjanjian pengikatan jual beli sering kali dijadikan sebagai penjanjian awal yang dibuat oleh pelaku pembangunan rumah susun untuk memasarkan atau menjual satuan rumah susun yang dikembangkannya. Peraturan Pemerintah Republik Indonesia Nomor 12 tahun 2021 tentang Perubahan Atas Peraturan Pemerintah Nomor 14 Tahun 2016 Tentang Penyelenggaraan Perumahan dan Kawasan Permukiman telah mengatur pedoman yang dapat digunakan oleh notaris maupun pelaku pembangunan dalam pembuatan perjanjian pengikatan jual beli. Videoconference merupakan salah satu media teknologi yang mulai digunakan oleh profesi hukum dalam melaksanakan tugasnya. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan Perundang-undangan dan juga pendekatan konsep. Dari hasil penelitian, dapat disimpulkan bahwa notaris belum optimal dalam memasukan materi muatan yang diatur dalam Peraturan Pemerintah. Dengan memenuhi syarat yang diatur dalam KUH Perdata, UU Rusun dan UUJN perjanjian pengikatan jual beli secara notaril yang dibuat melalui videoconferences memiliki kekuatan hukum yang sempurna namun dapat terdegradasi berdasarkan putusan pengadilan yang telah memiliki kekuatan hukum tetap./The binding sale and purchase agreement is often used as an initial agreement made by developer of apartment to promote or sell the apartment units they will developed. Government Regulation of the Republic of Indonesia Number 12 of 2021 concerning Amendments to Government Regulation Number 14 of 2016 concerning the Implementation of Housing and Settlement Areas has set out a guidelines that can be used by notaries and apartment developer in making a binding sale and purchase agreements. Videoconferencing is one of the technological media that the legal profession has begun to use in carrying out their duties. In this study, data collection was carried out using a legislative approach as well as a conceptual approach. From the results of the study, it can be concluded that the notary is not optimal in entering the content stipulated in the Government Regulation. By fulfilling the requirements as stipulated in the KUH Perdata, the Apartment Law and the Notary Law, a notarized binding sale and purchase agreement made through videoconferences has impeccable legal force however it can be degraded based on a court decision that has permanent legal force.
