Pasal 1 UU Hak Tanggungan mengatur bahwa, PPAT adalah pejabat umum yang diberi wewenang untuk membuat akta pemindahan hak atas tanah, akta pembebanan hak atas tanah, dan akta pemberian kuasa membebankan hak tanggungan, menurut peraturan perundang-undangan. Penelitian mengkaji Putusan Nomor 167/Pdt.G/2014/Pn.Jkt.Sel, Putusan Nomor 172/Pdt/2017/PT. DKI dan Putusan Nomor 918 K/Pdt/2018 yang membatalkan Surat Kuasa Membebankan Hak Tanggungan yang telah dibuat. Dalam penelitian Tesis ini, Penulis menggunakan pendekatan undang-undang (statute approach) dan pendekatan kasus. Penelitian ini mengkaji doktrin kelalaian kontribusi (contributory negligence) sebagai perbuatan melawan hukum dalam putusan yang dibuat oleh majelis hakim dalam putusan pengadilan tersebut. Hasil dari penelitian ini adalah bahwa para penggugat sebagai pihak korban telah turut serta melakukan kelalaian kontribusi (contributory negligence) dan menyarankan agar pemerintah membuat aturan terhadap penggugat (korban) yang berkontribusi atas kerugian yang dideritanya. / Article 1 of the Mortgage Law stipulates that, PPAT is a public official who is authorized to make a deed of transfer of land rights, deed of assignment of land rights, and deed of granting power to impose mortgage rights, according to the laws and regulations. The study examines Decision Number 167/Pdt.G/2014/Pn.Jkt.Sel, Decision Number 172/Pdt/2017/PT. DKI and Decision Number 918 K/Pdt/2018 which cancels the Power of Attorney to impose Mortgage Rights that has been made. In this thesis research, the author uses a statute approach and a case approach. This study examines the doctrine of contributory negligence as an unlawful act in the decision made by the panel of judges in the court's decision. The results of this study are that the plaintiffs as the victims have participated in contributing negligence and suggest that the government make rules against the plaintiffs (victims) who contributed to the losses they suffered.
