Abstract

Penelitian ini bertujuan untuk menganalisis pengaturan dan perlindungan hukum atas pengelolaan dan pengusahaan sarang burung walet di Indonesia, baik dari pemerintah pusat dan juga pemerintah daerah, serta implemntasi pengaturan proses penyelesaian permasalahan sehubungan dengan adanya pelanggaran yang dilaukan oleh pengusaha sarang burung walet yang ada di Kabupaten Melawi. Jenis data dalam penelitian ini merupakan penelitian hukum Normatif Empiris yang merupakan penggabungan antara pendekatan hukum normative dengan penambahan unsur-unsur empiris. Jenis data dalam penelitian ini menggunakan jenis data Primer, dengan bahan hukum primer dan bahan hukum sekunder. Teknik pengumpulan data berupa data sekunder yang di dukung dengan data primer. Pengaturan yang jelas terkait pengaturan dan perlindungan hukum atas pengelolaan dan pengusahaan sarang burung walet di Indonesia di atur di dalam Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan hidup, Keputusan Menteri Kehutanan Nomor 100/Kpts-II/2003 tentang Pedoman Pemanfaatan Sarang Burung Walet, Keputusan Menteri Pertanian tentang Pedoman Perizinan dan Pendaftaran Usaha Peternakan, Peraturan Pemerintah Nomor 16 tahun 2021 tentang Bangunan Gedung, Peraturan Bupati, dan berbagai peraturan-peraturan daerah lainnya. Pada prakteknya banyak sekali para pengusaha sarang burung walet yang tidak menjalankan aturan yang sudah ada. Para pengusaha tidak menjalankan aturan tersebut dikarenakan tidak terdapatnya pengaturan yang spesifik terkait pengelolaan sarang burung walet di Kabupaten Melawi. Peraturan Daerah merupakan salah satu solusi bagi para masyarakat yang terdampak dari peternakan sarang burung walet dan juga pengusaha sarang burung walet agar dalam menjalankan pekerjaannya terdapat landasan hukum, dan tertib dalam melakukan usaha./This study aims to analyze the legal arrangements and protections for the management and exploitation of swallow nests in Indonesia, both from the central government and local governments, as well as the implementation of the regulation of the problem solving process in connection with violations committed by swallow nest entrepreneurs in Melawi Regency. . The type of data in this research is an empirical normative legal research which is a combination of a normative legal approach with the addition of empirical elements. The type of data in this study uses primary data types, with primary legal materials and secondary legal materials. Data collection techniques in the form of secondary data supported by primary data. Clear arrangements related to the regulation and legal protection of the management and exploitation of swallow's nests in Indonesia are regulated in Law Number 32 of 2009 concerning Protection and Management of the Environment, Decree of the Minister of Forestry Number 100/Kpts-II/2003 concerning Guidelines for Nest Utilization. Swallows, Decree of the Minister of Agriculture regarding Guidelines for Licensing and Registration of Livestock Businesses, Government Regulation Number 16 of 2021 concerning Buildings, Regent Regulations, and various other regional regulations. In practice, there are many swallow nest entrepreneurs who do not follow the existing rules. The entrepreneurs do not follow these rules because there are no specific regulations related to the management of swiftlet nests in Melawi Regency. Regional regulations are one solution for communities affected by swiftlet nest farming and also swallow nest entrepreneurs so that in carrying out their work there is a legal basis, and orderly in doing business.
