Abstract
Condominium is a storey building being inhabited together and each unit
is owned separately. Those inhabitants would not be able to be eluded on the
needs of the public purposes, shared goods and shared land. The management of
those public purposes use is arranged and being performed by an authorized
organisation, which is the Association of the Owners and Occupants of
Condominium (Perhimpunan Pemilik dan Penghuni Satuan Rumah Susun
(“PPPSRS”)), in a form of a legal entity that enable this organization to conduct
any approriate legal action necessary. The formation of this organization must be
made in a form of a legal authentic deed, therefore clearly there is the needs for
the role of a Notary Public. Based on the mentioned matters, then the purpose of
this research is to search, find, and analise the role of the Notary Public as well as
the obstacles to conduct the formation and establishment of PPPSRS according to
the Condominium Law No. 20 Year 2011, and the management of the shared
land, public purposes use, and shared goods of condominium before the formation
of the PPPSRS, and the legal consequences when the developer is unanttentive
and negligent to form the mention PPPSRS.
The research is a Juridical Normative (Yuridis Normatif) research, and the
approachs being applied to discuss the problems are statue approach and
conceptual approach.
Based on the research being done, it can be concluded that the role of the
Notary Public is to write down the minutes of the meetings on any matters take
place during the formation meeting and is not the party who authorized to ratify
the deed of incorporation and articles of association of PPPSRS, therefore the
party who has the authorization shall be the relevant government institutions as
explained in Article 54 point (2) of the Government Regulation No. 4 Year 1988
regarding Condominiums, and prior to the formation of PPPSRS, the developer
shall act as the temporary association and help in the preparation to form the
PPPSRS as soon as possible. If the owner of the condominium units or the
developer are unattentive or negligent to form the establishment of PPPSRS in the
mentioned period, then there will be an administrative sanctions in accordance
with the provisions of Article 108 (1) Administrative Sanctions as referred in
Article 107. / Rumah susun merupakan bangunan bertingkat yang dihuni bersama dan
merupakan satuan yang dimiliki secara terpisah. Penghuni rumah susun tidak
dapat menghindarkan diri atau melepaskan kebutuhannya untuk menggunakan
bagian bersama, benda bersama dan tanah bersama. Pengelolaan atas penggunaan
bagian-bagian yang merupakan milik bersama diatur dan dilakukan oleh suatu
organisasi yang diberi wewenang dan tanggung jawab yaitu Perhimpunan Pemilik
dan Penghuni Satuan Rumah Susun (PPPSRS), yang harus berbentuk badan
hukum untuk dapat melakukan perbuatan hukum. Pembentukan PPPSRS tersebut
dibuat dalam akta autentik, dan dalam hal ini secara jelas terdapat peran Notaris.
Berdasarkan hal tersebut, tujuan penelitian ini adalah untuk menelusuri,
menemukan, menganalisis peran Notaris dan kendala yang ada dalam
melaksanakan pembentukan dan pendirian PPPSRS berdasarkan Undang-Undang
Rumah Susun Nomor 20 Tahun 2011, serta pengelolaan tanah bersama, bagian
bersama dan benda bersama rumah susun sebelum terbentuknya PPPSRS, dan
akibat hukumnya apabila pihak pengembang lalai untuk membentuk PPPSRS.
Penelitian ini merupakan penelitian Yuridis Normatif, dan pendekatan
yang diterapkan penulis untuk membahas permasalahan dalam penelitian ini
adalah melalui pendekatan Undang-Undang (statue approach) dan pendekatan
konseptual (conceptual approach).
Berdasarkan hasil penelitian dapat disimpulkan bahwa peranan Notaris
yang sesungguhnya adalah sebagai pembuat risalah/notulen rapat mengenai halhal yang terjadi dalam rapat pembentukan bukan sebagai pihak yang mempunyai
kewenangan mengesahkan akta pendirian dan anggaran dasar serta anggaran
rumah tangga PPPSRS, karena yang berhak mengesahkan adalah Instansi
Pemerintah sebagaimana tertuang dalam Pasal 54 ayat (2) Peraturan Pemerintah
Nomor 4 Tahun 1988 tentang Rumah Susun, serta sebelum PPPSRS terbentuk,
maka Pelaku Pembangunan Rumah Susun wajib betindak sebagai perhimpunan
penghuni sementara dan membantu penyiapan terbentuknya PPPSRS secepatnya.
Dalam hal pemilik sarusun atau Pelaku Pembangunan lalai untuk membentuk
PPPSRS dalam jangka waktu sebagaimana dimaksud di atas, maka berakibat
sanksi administratif sesuai dengan ketentuan Pasal 108 (1) Sanksi administratif
sebagaimana dimaksud dalam Pasal 107.
