Abstract

In carrying out its duties, the National Land Agency is assisted by Land Deed Official and other officials appointed by the Minister to carry out land registration activities/process. The other official is called as Subdistrict Head as Interim Land Deed Official. The Sub district Head as Interim Land Deed Official is particularly needed in areas where there is not enough Land Deed Officer. In this study, the type of research is using normative juridical research. The type of approach is using the both of legislation and conceptual approach.From this research, it can be concluded that Interim Land Deed Official actually have same authority with Land Deed Official to make deed as regulated in Article 2 of Government Regulation No.37 Year 1998 concerning Regulation of Position of Land Deed Official. The authority of Land Deed Official is also regulated in Article 3 Regulation of Head of National Land Agency Number 1 Year 2006. While the legal foundation for appointment of sub district head as Interim Land Deed Officials determined in Article 5 Paragraph (3) Government Regulation No.37 Year 1998. / Dalam menjalankan tugasnya, Badan Pertanahan Nasional dibantu oleh PPAT dan pejabat lain yang ditunjuk oleh Menteri memberikan pelayanan kepada masyarakat untuk proses pendaftaran Tanah. Pejabat lain yang dimaksud adalah Camat sebagai PPAT Sementara. Camat sebagai Pejabat Pembuat Akta Tanah Sementara sangat dibutuhkan khususnya di wilayah yang belum cukup terdapat PPAT. Dalam penelitian ini, jenis penelitian yang digunakan adalah penelitian yuridis normatif. Pendekatan yang digunakan adalah pendekatan perundangundangan dan pendekatan konseptual. Dari penelitian tersebut dapat disimpulkan bahwa PPAT Sementara memiliki wewenang yang sama dengan PPAT yaitu kewenangan untuk membuat akta sebagaimana yang diatur didalam Pasal 2 Peraturan Pemerintah No.37 Tahun 1998 tentang Peraturan Jabatan Pejabat Pembuat Akta Tanah. Dalam hal kewenangan PPAT juga diatur didalam Pasal 3 Peraturan Kepala Badan Pertanahan Nasional Nomor 1 Tahun 2006. Sedangkan dasar hukum penunjukan camat sebagai PPAT Sementara ditentukan didalam Pasal 5 ayat (3) Peraturan Pemerintah No.37 Tahun 1998.
