Abstract

Kehadiran pinjaman online dengan peran teknologi banyak menawarkan pinjaman dengan syarat dan ketentuan lebih mudah dan fleksibel dibandingkan dengan lembaga keuangan konvensial seperti bank.sehingga banyaknya minat masyarakat dalam melakukan transaksi online pada dunia fintech , Masalah yang terjadi ialah belum tersedia peraturan perlindungan data pribadi dalam pinjaman online dan belum terdapat jelas tentang adanya suatu bentuk perlindungan dalam segi pengaturan dan juga pelaksanaan terhadap data pribadi dalam pinjaman online , yang dapat mengatur dan melindungi pengguna layanan berbasis aplikasi online tersebut atau yang disebut P2P lending. Metode penelitian yang dipergunakan bersifat normative. Adapun bahan hukum yang digunakan,bahan hukum primer, bahan hukum sekunder, maupun bahan hukum tersier yang dianalisis secara deskriptif, dengan logika deduktif. Hasil penelitian menunjukkan bahwa kegiatan pinjol telah diatur dalam Peraturan OJK No 77/ POJK.01/2016 tentang Layanan Pinjam Meminjam Uang Berbasis Teknologi Informasi, UU Tahun 2008 Tentang Informasi dan Transaksi Elektronik serta UU Perlindungan Konsumen Tahun 1999. Namun demikian, aturan tersebut belum sepenuhnya mengatur secara mendalam norma-norma perlindungan data pribadi yang sesuai dengan perkembangan saat ini. Dari segi pelaksanaan pemerintah dalam menjamin perlindungan data pribadi dalam praktik pinjaman online melalui langkah preventif dan represif. Diantaranya dengan mengatur pencegahan munculnya pinjaman online yang tidak terdaftar. Sementara itu, upaya represif dilakukan berdasarkan POJK No. 77/POJK.01/2016. Kata Kunci : Perlindungan Hukum, Data Pribadi, Pinjaman Online /The presence of online lending with the role of technology offers many loans with easier and more flexible terms and conditions compared to conventional financial institutions such as banks. So although there is a lot of public interest in making online transactions in the financial technology world, the problem that occurs is that there are no regulations for protecting personal data in online lending and it is not clear that there is a form of protection in terms of regulation and implementation of personal data in online lending, which can regulate and protect users of these online application-based services or so-called P2P lending. This study approach normative methodology, which used legal substances, secondary, and tertiary legal substances descriptively investigated by applying a deductive approach. The study's findings suggest that the 1999 Consumer Protection Law, the 2008 Law on Information and Electronic Transactions, and OJK Regulation No. 77/POJK.01/2016 concerning Information Technology�Based Borrowing-Lending Services control lending and borrowing operations. Nevertheless, the aforementioned regulations do not entirely regulate the standards for protecting personal data in light of recent advancements. Regarding the use of preventative and punitive government actions to ensure the safety of private information in online lending operations. To stop the rise of unregistered internet lending, for example, regulations must be in place. In the interim, repressive measures were implemented in accordance with POJK No. 77/POJK.01/2016.
