Abstract

Penelitian ini membahas tentang pemberian sanksi terhadap anak dibawah umur sebagai anak yang berhadapan dengan hukum khususnya anak yang berkonflik dengan hukum. Penyelesaian perkara terhadap anak yang masih dibawah umur harus mengacu pada UU No 11/2012 sebagai lex specialis sehingga pemberian sanksi seharusnya juga mengacu pada UU tersebut. UU No 11/2012 memiliki prinsip restorative justice sehingga pemberian sanksi memiliki opsi selain sanksi pidana yaitu sanksi tindakan. 11 anak punk yang terjerat razia merupakan anak yang masih dibawah umur sehingga menjadi anak yang berhadapan dengan hukum. Sehingga pemberian sanksi terhadap 11 anak punk berupa penggundulan tersebut harus mengacu pada hukum positif yang berlaku terhadap anak. Penelitian ini menggunakan metode penelitian Yuridis-Normatif yangdilakukan dengan cara studi pustaka terhadap bahan hukum yang tersedia. Metode penelitian ini akan digunakan untuk menganalisis sanksi terhadap 11 anak punk tersebut sesuai dengan hukum positif yang berlaku. / This study discusses the imposition of sanctions on minors as children in conflict with the law, especially children in conflict with the law.The settlement of cases against minors must refer to Law No. 11/2012 as a lex specialis so that the imposition of sanctions should also refer to the Law. Law No. 11/2012 has the principle of restorative justice so that the provision of sanctions has an option other than criminal sanctions, namely action sanctions. The 11 punk children caught in the raid were minors, so they were in conflict with the law. So that sanctions against 11 punk children in the form of baldness must refer to the positive law that applies to children. This study uses a juridical normative research method which is carried out by means of a literature study of the available legal materials. This research method will be used to analyze the sanctions against the 11 punk children in accordance with the applicable positive law.
