Tugas akhir ini dibuat dengan melakukan analisis terhadap pengaturan hukum positif Indonesia yang berlaku mengenai perlindungan data pribadi di Indonesia, serta bentuk perlindungan hukum bagi nasabah/tertanggung asuransi Allianz jika terjadi penyalahgunaan data pribadi khususnya yang berkaitan dengan kesehatan. Maka dari itu penulis berkeinginan untuk menyusun skripsi dengan judul “Perlindungan Hukum Atas Data Pribadi Terkait Kesehatan Nasabah/Tertanggung Terhadap Asuransi Allianz”. Tujuan penulisan tugas akhir ini adalah untuk memahami dan menganalisa bentuk perlindungan hukum tertanggung asuransi atas pencurian data pribadi sesuai hukum positif yang berlaku di Indonesia. Sedangkan tujuan akademis dari penulisan skripsi ini dimaksudkan untuk melengkapi serta memenuhi salah satu prasyarat untuk memperoleh gelar sarjana hukum (s1) pada Fakultas Hukum Universitas Pelita Harapan Kampus Surabaya. Hasil analisis dalam tugas akhir ini dapat disimpulkan bahwa bentuk perlindungan hukum atas pencurian data pribadi terkait kesehatan konsumen / tertanggung Allianz diatur dalam Pasal 30 UU Asuransi jo. Pasal 26 UU ITE dan telah diatur pula sanksi bagi pelakunya pada pasal 46 UU ITE. /This final project is made by analyzing the positive Indonesian legal arrangements that apply to the protection of personal data in Indonesia, as well as forms of legal protection for customers/insured Allianz insurance in case of misuse of personal data, especially those related to health. Therefore, the author wishes to compile this final project titled "Legal Protection of Personal Data Related to the Health of Customers/Insured Against Allianz Insurance". This final project aims to understand and analyze the form of legal protection for the insured against the theft of personal data in accordance with positive laws in Indonesia. The academic purpose of writing this final project is to complete and fulfill one of the prerequisites for obtaining a law degree (S1) at the Faculty of Law, Pelita Harapan University, Surabaya. The results of the analysis in this final project can be concluded that the form of legal protection for the theft of personal data related to the health of consumers / Allianz insured is regulated in Article 30 of the Insurance Law Jo Article 26 of the ITE Law and regulated sanctions for the perpetrators in Article 46 of the ITE Law.
