Abstract
The need for the availability of housing is an obstacle given the limited land that is
getting narrower, which has an impact on soaring land prices in the capital.
Therefore, there is a need for a breakthrough and wise steps in preparing and
building housing for the community in a vertical direction, which is referred to as
the construction of flats or apartments. Arrangement of Ownership Rights over
Flats Units built on privately owned land or belonging to the developer, the
certificate is Pure HGB or SHM with a period of 30 years which has the highest
status and can be renewed with a deed of granting Building Use Rights over
Property Rights and Arrangement of Property Rights For Flats Units above HGB
or Utilization Rights over State Land and Management Rights (HGB Management),
can only utilize the land for use and use to build buildings, while the ownership of
the land remains state property so that the HGB certificate to be issued has a limit
a period of 30 (thirty) years, and then can be extended for a maximum period of 20
(twenty) years, and renewed for a maximum period of 30 (thirty) years. This study
aims to analyze the legal certainty of ownership of flat ownership certificates on
HGB land which have a validity period and can potentially cause losses due to legal
uncertainty and legal protection if the HGB status cannot be renewed. / Kebutuhan akan tersedianya perumahan menjadi kendala mengingat keterbatasan
lahan yang semakin sempit sehingga membawa dampak melambungnya harga
tanah di ibukota, Oleh karena itu, perlunya suatu terobosan dan langkah yang
bijaksana dalam mempersiapkan dan membangun suatu perumahan bagi
masyarakat kearah vertikal yang disebut sebagai pembanguan rumah susun atau
apartemen. Pengaturan Hak Milik atas Satuan Rumah Susun yang dibangun di atas
Tanah hak milik pribadi atau milik developer maka sertifikatnya adalah HGB
Murni atau SHM dengan jangka waktu 30 tahun yang memiliki status tertinggi dan
dapat diperbahrui dengan akta pemberian Hak Guna Bangunan diatas Hak Milik
dan Pengaturan Hak milik atas Satuan Rumah Susun diatas HGB atau Hak Pakai
di atas Tanah Negara dan Hak Pengelolaan (HGB Pengelolaan), hanya bisa
memanfaatkan tanah tersebut untuk digunakan dan dimanfaatkan mendirikan
bangunan, sedangkan kepemilikan tanah tersebut adalah tetap menjadi milik
negara sehingga sertifikat HGB yang akan diterbitkan memiliki batas jangka
waktu 30 (tiga puluh) tahun, dan kemudian dapat diperpanjang Kembali dengan
jangka waktu paling lama 20 (dua puluh) tahun, dan diperbarui kembali untuk
jangka waktu paling lama 30 (tiga puluh) tahun. Penelitian ini bertujuan untuk
menganalisis kepastian hukum kepemilikan Sertifikat hak milik satuan rumah
susun di atas tanah HGB yang memiliki masa berlaku dan dapat berpotensi
menimbulkan kerugian karena adanya ketidakpastian hukum dan perlindungan
hukum apabila status HGB tersebut tidak dapat diperpanjang kembali.
