Abstract

Seiring kemajuan teknologi yang terus terjadi, sebagian besar orang terpapar internet dan berpotensi menjadi korban kejahatan dunia maya. Mengingat betapa lumrahnya internet dalam kehidupan sehari-hari masyarakat, masalah kejahatan dunia maya perlu diperhatikan, ditangani, dan diselidiki lebih dari sebelumnya. Tujuan dari penelitian ini adalah untuk menggali dan mengembangkan temuan-temuan baru mengenai dunia maya dan hukum kejahatan dunia maya khususnya di Indonesia. Namun tesis ini didasarkan pada studi penulis tentang spionase ekonomi siber dan analisis hukum. Pengumpulan data dilakukan melalui internet dan studi pustaka dengan fokus pada isu yurisdiksi di Indonesia dalam menangani spionase ekonomi siber; Data dikumpulkan dari berbagai institusi yang saling terkait dengan bidang yang diteliti. Studi ini akan membantu untuk mengisi kesenjangan antara peraturan kejahatan dunia maya dalam menentukan yurisdiksi dan membawa manfaat bagi lembaga yang bertanggung jawab untuk memulai undang-undang untuk spionase ekonomi dunia maya dan melakukan amandemen pada undang-undang yang ada untuk memberikan kepastian hukum yang lebih. Untuk memahami pentingnya inovasi dan kesulitan yang dihadapi, studi ini juga melihat tanggapan hukum internasional dan kerangka hukum regional. Pada akhirnya, tesis ini berisi saran-saran untuk solusi atas permasalahan hukum yang dibahas. / As technological progress continue to happen, the majority of people become exposed to the internet and could potentially become a victim of cybercrime. Given how commonplace the internet is in people's daily lives, the problem of cybercrime needs to be noticed, tackled, and investigated more than ever. The aim of the study is to explore and develop new findings regarding the cyberspace and cybercrime law particularly in Indonesia. This thesis however is based on the writer’s study about cyber economic espionages and analysis of laws. The data is collected through the internet and library research with the focus on the issue of jurisdiction in Indonesia in handling cyber economic espionages; the data was collected from different institutions that are interrelated with the field that is examined. This study will help to fill the gap between cybercrimes regulation in determining jurisdiction and bring benefits to the responsible institutions to initiate a legislation for cyber economic espionages and amend the existing law to give more legal certainty. In order to understand the significance of innovation and the difficulties the industry encounters, the study also looked at the experiences of international legal responses and regional legal frameworks. Finally, this thesis consist of suggestions for a solution for the current legal issue.
