Abstract
Penelitian ini ditujukan untuk mengkaji dan menganalisa kepastian hukum bagi hukum bagi pemegang Sertifkat Hak Milik atas tanah terhadap gugatan dari pihak lain dan menganalisa Putusan MA Nomor : 2933 K/PDT/2021. Bagaimana kekuatan Sertifikat Hak Milik atas Tanah sebagai alat bukti di pengadilan dan pertimbangan hakim terhadap tanda bukti kepemilikan tanah tersebut. Penelitan ini menggunakan metode kualitatif dengan pendekatan hukum normatif emipiris. Teknik analisa yang digunakan adalah analisis kualitatif, yaitu data sekunder yang dikumpulkan dan diolah untuk perumusan kesimpulan. Sertifikat hak atas tanah adalah alat bukti yang kuat sebagaimana diatur dalam Pasal 32 ayat (1) PP Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah. Hasil penelitian menunjukkan perlindungan hukum terhadap pemilik hak atas tanah dalam hal terdapat gugatan dari pihak lain mendapatkan perlindungan hukum sebagaimana dalam UU Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria Pasal 19 ayat (2) huruf c, Pasal 23 ayat (2), Pasal 32 ayat (2) dan Pasal 38 ayat (2), dan PP Nomor 24 Tahun 1997 Pasal 32 ayat (1), surat-surat tanda bukti hak berlaku sebagai alat pembuktian yang kuat. Pemegang Sertifikat Hak Milik atas tanah meskipun masih dapat digugat oleh pihak lain tetapi memiliki kekuatan hukum sepanjang pihak lain yang menggugat tidak dapat membuktikan sebaliknya. / This research is aimed at examining and analyzing legal certainty for holders of land ownership certificates against lawsuits by other parties and analyzing the Supreme Court Decision Number: 2933 K/PDT/2021. How is the strength of the Land Ownership Certificate as evidence in court and the judge's consideration of the evidence of land ownership. This research uses qualitative methods with an empirical normative legal approach. The analysis technique used is qualitative analysis, namely secondary data collected and processed for the formulation of conclusions. Land rights certificates are strong evidence as stipulated in Article 32 paragraph (1) PP Number 24 of 1997 concerning Land Registration. The results of the research show that legal protection for owners of land rights in the event that there is a lawsuit from another party gets legal protection as in Law Number 5 of 1960 concerning Basic Agrarian Regulations Article 19 paragraph (2) paragraph c, Article 23 (2), Article 32 paragraph (2) and Article 38 paragraph (2), and Government Regulation Number 24 of 1997 Article 32 paragraph (1), letters of proof of rights are valid as a strong means of proof. Even though the holder of a certificate of ownership rights over land can still be sued by another party, it has legal force as long as the other party who is suing cannot prove otherwise.
