Abstract

People who are oriented on the economy in the agricultural sector have switched to the industrial sector, and lastly to the creative economy sector, as a result of economic development and advancement. With the economic age changing to the creative sector, an effort is required to support the creative industry or economic players through finance for the development of their commercial operations. According to Indonesian positive law, intellectual property rights can be bound by a fiduciary assurance (as stated in Article 108 paragraph (1) of Patent Act Number 13 of 2016 about Patents and Article 16 paragraph (3) of Copy Rights Act Number 28 of 2014) and a variety other unstated intellectual property rights which could be utilized as fiduciary assurances. According to Article 1 paragraph (2) of Fiduciary Assurance Act Number 42 of 1999, fiduciary guarantees can bind intangible assets. Therefore, under Indonesian law, intellectual property rights have the potential to become collateral objects in financial institutions. However, the fact that intellectual property rights are still not seen as collateral objects in the Indonesian banking industry is a result of a variety of factors, including: banking institutions reluctance to accept intellectual property rights as collateral because they must apply the precautionary principle, and there is uncertainty law based on the word "may" contained in Article 43 of Bank Indonesia Regulation Number 14/15/PBI/2012. As such, in the study of this this case, the author employed a normative-empirical research method to breakdown the case. This study will also be supported through interviews and research activities done by the author.
