Bank Tabungan Negara as one of Indonesian Bank, run his duty for credit distribution. Credit facility is carried out with a continuous procedure in order to be in accordance with the stated objectives to produce healthy and profitable credit by following the Precautionary Principle, Good Corporate Governance, and Four Eyes Principles. Credit facility are regulated in Attachment III of POJK 03.2017 Part III number 4 regarding the implementation of credit contracts. There is a covernote from a Notary stating that all original collateral files that have not been received are still being used in the administrative process at the authorized Government Institurion and will be submitted to the Bank at the agreed time after the administrative process is completed. Notary who not carrying out the obligations that stated in their covernote causes a credit risk dan operational risk for the Bank as well as a potential loss for the debts losses their land ownership. Covernote is not regulated by the laws and current regulations in Indonesia. The Notary who made a covernote based on authority granted by the Bank.Covernote is an alliance that born from an agreement, according to article 1316 of The Civil Code. The Notary who default on their covernote are civilly responsible.
