Abstract
Pendaftaran Hak Tanggungan saat ini dilakukan secara elektronik, hal ini mulai dipraktekkan semenjak lahirnya Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 5 Tahun 2020. Dengan adanya pendaftaran Hak Tanggungan secara eleketronik diharapkan mampu mengimbangi kemajuan teknologi di era digital saat ini. Selain itu tentu saja sebagai bentuk perkembangan hukum pertanahan di Indonesia agar dapat dilaksanakan dengan terintegrasi, efektif dan efisien. Namun demikian masih banyak kendala yang dihadapi dalam pendaftaran Hak Tanggungan secara elektronik yang mana mampu membuat hilangnya kepastian hukum atas status kreditur sebagai pemegang hak tanggungan. Dalam Penelitian ini, pengumpulan data dilakukan dengan cara Penelitian kepustakaan (library research) yang pendekatannya dilakukan secara pendekatan undang-undang (statue approach). Dari hasil Penelitian tersebut, dapat disimpulkan bahwa pendaftaran Hak Tanggungan yang dilakukan secara elektronik yang kemudian pendaftarannya melebihi ketentuan jangka waktu karena ada kendala teknis dapat mengakibatkan hilangnya kepastian hukum yang seharusnya dimiliki oleh kreditur. Perlindungan hukum yang seharusnya diperoleh kreditur atas haknya pun dapat gugur dihadapan pihak ketiga. Kesiapan sistem, sumber daya manusia maupun peran PPAT sangat berpengaruh dan mampu membantu tegaknya kepastian hukum serta perlindungan hukum terhadap kreditur sebagai pemegang Hak Tanggungan. / Registration of Mortgage Rights is currently carried out electronically, this has begun since the Regulation of the Minister of Agrarian and Spatial Planning / Head of the National Land Agency Number 5 of 2020. With the electronic registration of Mortgage Rights, it hoped will be able to keep up with technological advances in today's digital era. And as a form of development of land law in Indonesia so that it can be implemented in an integrated, effective and efficient manner. However, there are still many obstacles faced in the electronic registration of Mortgage Rights, which can cause a loss of legal certainty over the status of creditors as holders of mortgage rights. In this research, data collection is carried out by library research with a statue approach. From the results of the research, it can be concluded that the registration of electronic Mortgage Rights which exceeds the registration period due to technical obstacles can result in the loss of legal certainty that should be owned by the creditor. The readiness of the system, human resources and the role of PPAT are very influential and can help uphold legal certainty and legal protection for creditors as holders of Mortgage Rights.
