Abstract
Akta Notaris dengan tanda tangan elektronik masih belum diakui keabsahannya oleh UU ITE, sehingga perlu dianalisis untuk menemukan argumentasi hukum agar tanda tangan elektronik dapat digunakan dalam akta notaris agar dapat dilihatsebagai akta otentik karena akta otentik masih dikecualikan dalam Pasal 5 ayat 4 huruf B UU ITE. Metode yang digunakan dalam penelitian ini adalah metode pendekatan normatif empiris. Referensi yang digunakan dalam penelitian ini adalah undang-undang, peraturan keputusan dan kebijakan, buku, jurnal, sumber dari beberapa media elektronik dan didukung wawancara dengan notaris. Konsep cyber notary belum sepenuhnya diterapkan karena belum ada peraturan yangmengatur tentang pembuatan cyber notary secara detail karena UUJN tidak dijelaskan secara jelas, pengaturan mengenai cyber notary hanya terdapat dalam penjelasan Pasal 15 ayat 3 UUJN. Perlu penjelasan lebih lanjut mengenai cyber notary dalam UUJN agar dapat dilaksanakan sepenuhnya oleh seorang Notaris dalam menjalankan kewenangannya membuat akta notaris terutama untuk kenyamanan para pihak dan keabsahan khususnya pada akta-akta yang tidak dapatditunda dan tanda tangan Elektronik tanda tangan dapat mengantisipasi pemalsuan tanda tangan pada akta. Konsep cyber notary tidak hanya sekedar tanda tangan elektronik, namun menghadap notaris juga dapat dilakukan secara virtual yang dapat didukung oleh beberapa pasal dalam UUJN salah satunya pasal 15 ayat 3 dan pasal 16 ayat 7 dimana para penghadap dapat memilih apakah akta tersebut akan dibaca oleh notaris atau tidak. / Notary deeds with electronic signatures are still not recognized as valid by theElectronic Information and Transaction Law, so need to be analyzed in order tofind legal arguments so that electronic signatures can be used in notarial deeds sothat they can be seen as authentic deeds because authentic deeds are still excludedin Article 5 paragraph 4 letter B on Information and Electronic Transactions Law. The method used is the empirical normative approach method. The referencesused in this study are laws, decisions and policy regulations, books, journals,sources from several electronic media and supported by interviews with notaries.Concept of cyber notary have not been fully implemented because there are noregulations governing the making of cyber notaries in detail because the NotaryLaw is not clearly explained, the regulation regarding cyber notary is onlycontained in the elucidation of Article 15 paragraph 3 in Notary Law. Furtherexplanation is needed regarding the cyber notary in the Notary Law so it can befully implemented by a Notary in exercising his authority to make notarial deedsespecially for the convenience of the parties and validity, especially in deeds thatcannot be postponed and the sign Electronic signature can anticipate forgery ofsignatures on deed. The concept of a cyber notary is not only an electronicsignature, but facing a notary can also be done virtually which can be supportedby several articles in the Notary Law, one of which is article 15 paragraph 3 andArticle 16 paragraph 7 where the appearer can choose whether the deed is to beread by a notary or not.
