Abstract
The Financial Services Authority Act ("OJK") provides alternative dispute resolution
regarding disputes occurring with financial institutions. This is the preferred solution
given by OJK to consumers of financial services institutions, especially the banking
sector and the financing sector as a form of consumer protection with the aim of
creating legal certainty for the parties to the dispute. According to the background,
this research is structured to answer three issues, first, how is the dispute resolution
pattern of banking institution and financing institution based on Financial Service
Authority Regulation Number 1 / POJK.07 / 2014 About Alternative Institution of
Dispute Settlement in Financial Services Sector?; second, How is the implementation
of out of court dispute settlement of financial services of banking institutions and
financial institutions?; third, how is the dispute resolution pattern of banking
institutions and financial institutions in the future that can provide legal certainty for
consumers of banking institutions and consumers of financing institutions?
This research apply the normative law research method, which use secondary data.
According to comprehensive legal analitical by Researcher, it can be concluded,
first, the arrangement of dispute settlement of financial services at banking institution
and financing institution pursuant to OJK provision through alternative dispute
settlement is a good thing; second, OJK provides the procedure of out of court
settlement, through mediation, adjudication and arbitration; third, the settlement of
out of court dispute settlement is the national identity based on deliberation so that
the parties can obtain decisions that are well received by the parties and the
implementation of the execution should no longer require the registration of the
district court because the alternative institution of dispute resolution is an
independent institution. / Undang-undang Otoritas Jasa Keuangan (“OJK”) mengatur mengenai alternatif
penyelesaian sengketa di luar pengadilan bagi sengketa yang terjadi pada lembaga
jasa keuangan. Hal ini merupakan pilihan solusi bagi konsumen lembaga jasa
keuangan, khususnya sektor perbankan dan sektor pembiayaan sebagai bentuk
perlindungan konsumen dengan tujuan menciptakan kepastian hukum bagi para pihak
yang bersengketa. Berdasarkan latar belakang tersebut, penelitian ini disusun untuk
menjawab tiga permasalahan, yakni pertama, bagaimana pola penyelesaian sengketa
lembaga perbankan dan lembaga pembiayaan berdasarkan Peraturan Otoritas Jasa
Keuangan Nomor 1/POJK.07/2014 Tentang Lembaga Alternatif Penyelesaian
Sengketa di Sektor Jasa Keuangan?; kedua, Bagaimana implementasi mekanisme
pola penyelesaian sengketa jasa keuangan di luar pengadilan lembaga perbankan dan
lembaga pembiayaan?; ketiga, bagaimana pola penyelesaian sengketa lembaga
perbankan dan lembaga pembiayaan di masa depan yang dapat memberikan kepastian
hukum bagi konsumen lembaga perbankan dan konsumen lembaga pembiayaan?
Penelitian ini menggunakan metode penelitian hukum yuridis normatif, dengan
menggunakan data sekunder. Berdasarkan analisis hukum yang komprehensif, dapat
disimpulkan, hal-hal sebagai berikut, pertama, pengaturan penyelesaian sengketa jasa
keuangan pada lembaga perbankan dan lembaga pembiayaan berdasarkan ketentuan
OJK melalui alternatif penyelesaian sengketa merupakan hal yang baik; kedua, OJK
mengatur mengenai tata cara penyelesaian sengketa di luar pengadilan melalui
mediasi, ajudikasi dan arbitrase; ketiga, penyelesaian sengketa di luar pengadilan
merupakan jati diri bangsa berdasarkan asas musyawarah mufakat sehingga para
pihak dapat memperoleh keputusan yang diterima dengan baik oleh para pihak dan
pelaksanaan eksekusinya tidak lagi memerlukan pendaftaran di pengadilan negeri
karena lembaga alternatif penyelesaian sengketa merupakan lembaga independen dan
mandiri.
