Abstract
Notaris adalah pejabat umum yang berwenang untuk membuat akta autentik dan memiliki kewenangan lainnya sebagaimana dimaksud dalam UUJN/UU Nomor 2 Tahun 2014 atau berdasarkan undang-undang lainnya. Namun, kenyataannya kewenangan Notaris tidak hanya bersumber dari UUJN/UU Nomor 2 Tahun 2014 atau undang-undang lainnya, tetapi juga terdapat dalam Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 16 Tahun 2021 tentang Perubahan Ketiga atas Peraturan Menteri Negara Agraria/Kepala Badan Pertanahan Nasional Nomor 3 Tahun 1997 tentang Ketentuan Pelaksanaan Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah. Di dalam Pasal 111 Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 16 Tahun 2021 disebutkan bahwa surat keterangan ahli waris juga dapat dibuat oleh Notaris sebagai bukti ahli waris. Adapun rumusan masalah yang diteliti adalah bagaimana kepastian hukum dalam pembuatan surat keterangan waris di Indonesia dan bagaimana implementasi peranan Notaris dalam membuat surat keterangan ahli waris di Kota Padang. Metode penelitian yang digunakan adalah yuridis empiris, dengan menggunakan metode pendekatan perundang-undangan dan pendekatan konseptual (conseptual approach). Adapun hasil penelitiannya adalah surat keterangan ahli waris dapat dibuat oleh ahli waris, dengan disaksikan oleh 2 (dua) orang saksi, diketahui oleh kepala desa/lurah dan camat. Selain itu surat keterangan ahli waris juga dapat dibuat oleh Notaris atau Balai Harta Peninggalan. Surat keterangan ahli waris yang dibuat oleh ahli waris digolongkan sebagai akta di bawah tangan, sedangkan surat keterangan ahli waris yang dibuat oleh Notaris digolongkan sebagai akta autentik. Implementasi pembuatan surat keterangan ahli waris melalui Notaris di Kota Padang masih mengacu kepada ketentuan Pasal 111 Peraturan Menteri Negara Agraria/Kepala Badan Pertanahan Nasional Nomor 3 Tahun 1997 tentang Ketentuan Pelaksanaan Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah. Notaris hanya akan membuatkan surat keterangan ahli waris dari golongan warga negara Indonesia keturuan Tionghoa, sedangkan bagi warga negara Indonesia asli (bumiputera) dibuat oleh para ahli waris dengan disaksikan oleh 2 (dua) orang saksi, diketahui oleh kepala desa/lurah dan camat. / A notary is a general official who is authorized to make an authentic deed and has other authority as referred to in UUJN/UU Nomor 2 Tahun 2014 or based on other laws. However, the fact is that the authority of the Notary is not only sourced from UUJN/UU Nomor 2 Tahun 2014 or other laws, but also contained in the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 16 of 2021 concerning the Third Amendment to the Regulation of the Minister of State for Agrarian Affairs/Head of the National Land Agency Number 3 of 1997 concerning the Provisions for the Implementation of Government Regulation Number 24 of 1997 concerning Land Registration. In Article 111 of the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 16 of 2021 it is stated that the certificate of the heir can also be made by a Notary as evidence of the heir. The formulation of the problem studied is how legal certainty is in making an inheritance certificate in Indonesia and how to implement the role of a Notary in making a certificate of heirs in Padang City. The research method used is empirical juridical, using the law approach method and conceptual approach. The results of the research are that the certificate of the heirs can be made by the heirs, witnessed by 2 (two) witnesses, known by the village head/village head and sub-district head. In addition, the certificate of the heir can also be made by a Notary or Heritage Hall. The certificate of the heir made by the heir is classified as a deed under the hand, while the certificate of the heir made by the Notary is classified as an authentic deed. The implementation of making a certificate of heirs through a Notary in Padang City still refers to the provisions of Article 111 of the Regulation of the Minister of State for Agrarian Affairs/Head of the National Land Agency Number 3 of 1997 concerning the Provisions for the Implementation of Government Regulation Number 24 of 1997 concerning Land Registration. Notaries will only make certificates of heirs from the Chinese descent Indonesian citizens, while for native Indonesian citizens (bumiputera) they are made by heirs witnessed by 2 (two) witnesses, known by village heads/villages and sub-district heads.
