Abstract
um bagi kreditur atas Putusan Mahkamah Konstitusi Nomor
18/PUU-XVII/2019 berkaitan dengan Pengujian Undang-Undang Nomor 42
Tahun 1999 Tentang Jaminan Fidusia terhadap Undang-undang Dasar 1945,
melarang pihak perusahaan pembiayaan melakukan eksekusi terhadap barang
jaminan tersebut. Jadi, kenyataan ini menggugurkan Pasal 15 ayat (2) dan (3)
Undang-Undang Nomor 42 Tahun 1999 Tentang Jaminan Fidusia. Maka,
sertifikat jaminan fidusia itu tidak lagi memiliki kekuatan eksekutorial sehingga
putusan MK itu sendiri menurut hemat penulis justru akan sangat merugikan
pihak perusahaan pembiayaan khususnya terhadap debitur yang nakal atau
menunggak cicilan.Putusan Mahkamah Konstitusi tersebut menurut hemat penulis
dapat mencederai makna perjanjian antara pihak kreditur dan debitur dalam
perjanjian fidusia. Dalam perjanjian itu sendiri sebenarnya telah dikemukakan
persyaratan-persyaratan tertentu apabila debitur melakukan kelalaian pembayaran
atau wanprestasi seperti melakukan eksekusi terhadap barang yang dijaminkan
Putusan Mahkamah Konstitusi diatas justru menciptakan beberapa proses untuk
melakukan eksekusi terhadap barang atau aset debitur, sehingga pihak kreditur
sedikit terhambat dalam melakukan upaya eksekusi tersebut.Kepastian hukum
dapat diartikan bahwa suatu aturan hukum harus dirumuskan dan dibentuk secara
jelas, sehingga dapat memberikan kepastian hukum bagi setiap pihak. Mulai dari
pihak perusahaan pembiayaan, pemberi fidusia hingga penerima fidusia.
Khususnya berkaitan dengan Putusan Mahkamah Konstitusi yang dibahas dalam
tesis penulis. / Legal protection for creditors for the Constitutional Court Decision Number 18/PUU-XVII/2019 relating to the Review of Law Number 42 of 1999 Concerning Fiduciary Guarantees against the 1945 Constitution, prohibits finance companies from carrying out executions of these collateral items. So, this fact invalidates Article 15 paragraph (2) and (3) of Law Number 42 of 1999 Concerning Fiduciary Guarantees. Thus, the fiduciary guarantee certificate no longer has executive power so that the Constitutional Court's decision itself, according to the author, will actually be very detrimental to the finance company, especially to debtors who are naughty or are in arrears on installments. debtor in a fiduciary agreement. In the agreement itself, certain conditions have been stated if the debtor commits a default in payment or breach of contract, such as executing collateralized goods. execution. Legal certainty can be interpreted that a rule of law must be formulated and formed clearly, so as to provide legal certainty for each party. Starting from the financing companies, fiduciary providers to fiduciary recipients. Especially with regard to the Constitutional Court Decision which is discussed in the author's thesis.
