Sertipikat adalah surat tanda bukti hak sebagaimana dimaksud dalam Pasal 19 ayat (2) huruf c UUPA “pemberian surat-surat tanda bukti hak, yang berlaku sebagai alat pembuktian yang kuat”. Penerbitan sertipikat sesuai dengan data fisik dan data yuridis yang telah terdaftar dalam buku tanah berguna untuk kepentingan pemegang hak yang bersangkutan. Penelitian ini mengambil contoh kasus sengketa tanah dua surat di Jalan Darmo Permai Utara. Tergugat yang memiliki sertipikat berdasar akta jual beli dihadapan notaris dikalahkan oleh penggugat sebagai pemilik tanah dengan alas hak Petok sesuai dengan surat keterangan bekas milik adat. Dari hasil penelitian dapat dibuktikan bahwa data fisik dan data yuridis yang tercantum didalam sertipikat juga memiliki kekuatan hukum. Sertipikat hanya merupakan surat tanda bukti yang bersifat kuat dan bukan merupakan hak tanda bukti yang bersifat mutlak./A certificate is a letter of proof of rights as referred to in Article 19 paragraph (2) letter c of the UUPA "granting letters of proof of rights, which are valid as a strong means of proof". Issuance of certificates in accordance with the physical data and juridical data that have been registered in the land book is useful for the benefit of the right holder concerned. This study takes the example of a two-letter land dispute case on Jalan Darmo Permai Utara. The defendant who had a certificate based on the deed of sale and purchase before a notary was defeated by the plaintiff as the owner of the land with Petok rights in accordance with the certificate of former customary ownership. From the research results it can be proven that the physical data and juridical data listed in the certificate also have the force of law. The certificate is only a letter of proof that is strong in nature and is not an absolute right of proof.
