Abstract

This study aims to determine the regulation of criminal acts of fraud with fictitious orders in online transportation. The second objective is to find out the legal protection for drivers in criminal acts of fictitious order fraud. The type of research used by researchers is normative empirical research using a qualitative descriptive approach. The data source used is primary data and supports secondary data. That primary, secondary and tertiary laws are supported by questionnaires from the field that answer the problems studied. The results of this study are that the regulation of criminal acts of fraud with fictitious orders in online transportation is regulated in the KITAB of the Criminal Code for criminal acts of fraud contained in title XXV book II of the Criminal Code, namely article 378, Law Number 19 of 2016 concerning Information and Electronic Transactions. Violation of Article 28 paragraph (1) of the ITE Law is subject to criminal penalties as stipulated in Article 45A paragraph (1) of Law 19/2016, namely: Everyone who intentionally and without right spreads false and misleading news that results in consumer losses in Electronic Transactions as intended in Article 28 paragraph (1) shall be punished with imprisonment for a maximum of 6 (six) years and/or a maximum fine of Rp. 1,000,000,000.00 (one billion rupiah). So, from the formulations of Article 28 paragraph (1) of the ITE Law and Article 378 of the Criminal Code, we can see that both regulate different things. Article 378 of the Criminal Code regulates fraud, while Article 28 paragraph (1) of the ITE Law regulates fake news that causes consumer harm in electronic transactions. Legal protection is sought preventively through updating regulations relating to online transactions. Drivers as third parties in online transactions are not regulated explicitly in the ITE Law, so legal protection for drivers in criminal acts of fraud with fictitious orders is important for legal reform in terms of updating laws and regulations relating to the provision of services through online transactions. The Criminal Code also requires renewal in the context of online transactions as well./ Penelitian ini bertujuan untuk mengetahui pengaturan tindak pidana penipuan dengan order fiktif dalam transportasi online. Tujuan kedua yaitu untuk mengetahui perlindungan hukum terhadap driver dalam tindak pidana penipuan order fiktif. Jenis penelitian yang digunakan peneliti yaitu penelitian Normatif Empiris dengan menggunakan pendekatan deskriptif kualitatif. Sumber data yang digunakan adalah data primer dan mendukung data sekunder. Bahwa hukum primer, sekunder dan tersier didukung kuisioner dari lapangan menjawab masalah yang diteliti. Hasil penelitian ini bahwa pengaturan tindak pidana penipuan dengan order fiktif dalam transportasi online diatur pada KITAB Undang-Undang Hukum Pidana untuk tindak pidana penipuan terdapat dalam title XXV buku II KUH Pidana yaitu pasal 378, Undang-Undang-undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik. Pelanggaran Pasal 28 ayat (1) UU ITE ini diancam pidana sebagaimana diatur dalam Pasal 45A ayat (1) UU 19/2016, yakni: Setiap Orang yang dengan sengaja dan tanpa hak menyebarkan berita bohong dan menyesatkan yang mengakibatkan kerugian konsumen dalam Transaksi Elektronik sebagaimana dimaksud dalam Pasal 28 ayat (1) dipidana dengan pidana penjara paling lama 6 (enam) tahun dan/atau denda paling banyak Rp 1.000.000.000,00 (satu miliar rupiah). Jadi, dari rumusan-rumusan Pasal 28 ayat (1) UU ITE dan Pasal 378 KUH Pidana tersebut dapat kita ketahui bahwa keduanya mengatur hal yang berbeda. Pasal 378 KUH Pidana mengatur penipuan, sementara Pasal 28 ayat (1) UU ITE mengatur mengenai berita bohong yang menyebabkan kerugian konsumen dalam transaksi elektronik. Perlindungan hukum diupayakan preventif melalui pembaruan peraturan berkaitan dengan transaksi online. Driver sebagai pihak ketiga dari transaksi online tidak diatur secara eksplisit dalm UU ITE, sehingga perlindungan hukum terhadap driver dalam tindak pidana penipuan dengan order fiktif menjadi penting untuk dilakukan pembaruan hukum dalam hal pembaruan peraturan perundang-undangan berkaitan dengan pemberian jasa melalui transaksi online. KUH Pidana juga memerlukan pembaruan dalam rangka transaksi online juga.
