Abstract

Notaris adalah pejabat umum yang harus menjalankan jabatannya secara profesional, sebagai pejabat umum yang merupakan jabatan kepercayaan notaris harus menjaga isi akta dan keterangan-keterangan yang diperolehnya sebagai rahasia jabatannya. Kewajiban Notaris menjaga rahasia jabatannya merupakan sumpah/janji dari jabatannya yang diamanatkan oleh Undang-Undang. PP 43/2015 memasukan Notaris sebagai Pihak Pelapor untuk melaporkan keterangan pengguna jasanya pada Aplikasi GRIPS. Penulisan ini membahas bagaimana kedudukan notaris dalam menjaga rahasia jabatannya terhadap GRIPS dilihat dari Undang-Undang Jabatan Notaris dan perlindungan bagi notaris sebagai pihak pelapor dalam GRIPS.Metodologi penelitian yang digunakan dalam penulisan ini adalah penelitian hukum normatif. Jenis penelitiannya adalah kualitatif menggunakan data sekunder dengan teknik pengumpulan data kepustakaan. Penulis dalam penulisan ini menggunakan pendekatan perundang-undangan. Dapat disimpulkan kewajiban Notaris menjaga rahasia jabatan tersebut dapat dikecualikan menurut Pasal 16 ayat (1) huruf (f) UUJN 2/2014. Notaris sebagai Pihak Pelapor dalam GRIPS dilindungi, baik dari ancaman secara fisik maupun psikis terhadap Notaris, keluarganya dan hartanya. Perlindungan Notaris sebagai Pihak Pelapor dalam GRIPS berdasarkan peraturan. Perlindungan tersebut diberikan atas jaminan undang-undang atas konsekuensi notaris sebagai pelaksana menjadi pihak pelapor dalam PP 43/2015 dan perlindungan secara khusus yang diberikan oleh negara kepada Notaris melalui Kepolisian Republik Indonesia. Notaris harus menerapkan prinsip mengenali pengguna jasa agar dalam melaksanakan jabatannya Notaris dapat menimalisir permasalahan yang timbul dalam pelaksanaan jabatannya. / Notaries are public officials who must carry out their position professionally. As public official who is in a position of trust, notary must maintain the contents of the deed and information obtained as the secret of his position. The obligations of the notaries to keep the secrets of the position are an oath/promise mandated by the Act. PP 43/2015 includes a Notary as a Reporting Party to report information that user's gave to notary on the GRIPS Application. This writing discusses how the position of the notary in maintaining the secrets of their position against GRIPS, seen from the Act of notary and protection for the notary as the reporting party in GRIPS.The research methodology used in this paper is normative legal research. The type of research is qualitative using secondary data with library data collection techniques. Author of this paper uses the statutory approach. It can be concluded that the notary's obligation to maintain the position's secrets can be excluded according to Article 16 paragraph (1) letter (f) of UUJN 2/2014. Notary as a Reporting Party in GRIPS is protected, both from physical and psychological threats to notaries, their families and property. Protection to a notary as a Reporting Party in GRIPS is given based on Law.The protections are given as guaranteed by the law as a consequence of notaries as the reporting party in PP 43/2015 and special protection are provided by the state to the notaries through the Police of the Republic of Indonesia. Notaries must apply the principle of recognizing the service users so that in carrying out their positions notaries can minimize the problems that arise in the implementation of their positions.
