Abstract

Tindakan korupsi merupakan tindakan yang sangat merugikan banyak orang, dimana praktik korupsi ini sangat umum ditemukan di level individu hingga pada level institusi. Dalam konteks pendanaan pada desa, anggaran tersebut diturunkan dari level pemerintah pusat untuk pemerintahan golongan desa agar mampu membentuk dan meningkatkan kesejahteraan masyarakat dalam sebuah desa, akan tetapi juga praktek korupsi masih menjadi hambatan bagi sebuah desa untuk dapat terus berkembang secara efektif. Fenomena tindak pidana korupsi dapat dianalisis melalui teori keadilan bermartabat, dimana teori ini dapat melihat bagaimana sebuah tindakan kriminal harus dilandaskan pada hukum-hukum yang berlaku, agar para pelaku dari pada tindakan kriminal tersebut dapat dihukum sesuai dengan kejahatannya. Selain itu, teori ini juga ditujukan untuk melihat bagaimana aspek geografis dari sebuah desa harus bisa dikembangkan oleh masyarakatnya sendiri, melalui pengalokasian dana yang transparan dan maksimal. Sehingga demikian nantinya desa tersebut menjadi sebuah tempat yang layak dihuni bagi masyarakatnya, dan mensejahterakan penduduknya secara kolektif. Oleh karena itu, di perlukan pengawasan dan pengaturan mengenai dana desa harus bisa dilakukan dari sisi hukum, dimana praktek korupsi masih sering dijumpai dan menjadi sebuah hambatan dalam penyaluran alokasi dana desa./Corruption is an act that harms many people, where the practice of corruption can be found in individual level up to institution level. In a specific context of funding a village, the central government sends a financial budget for the village authority to develop and to increase the people’s prosperity, in which the act of corruption also become the challenges to develop the people's prosperity. The phenomenon of corruption can be viewed from the Justice Dignified Theory, where the theory emphasizes any criminal act that must be defended by the common law, for the people that act as a criminal can be punished equally based on the criminal act. Moreover, this theory can be elaborated as a tool in viewing the geography aspect of a village should be enhanced to develop the people’s life, by allocating a transparent and maximum funding. Therefore, the village can be a suitable place for its people, and could prosper the people collectively. That is why, supervision and legality about allocating village funding must be done in a legal way, where the practice of corruption still becomes the main challenge in sourcing village funding.
