Abstract
Perkembangan teknologi berdampak pada transaksi jual beli yang dapat dilakukan secara jarak jauh dimana penjual dan pembeli tidak perlu bertemu secara langsung. Perkembangan teknologi ini dimanfaatkan oleh perusahaan E-commerce untuk memudahkan transaksi jual beli melalui aplikasi milik perusahaan tersebut sesuai dengan ketentuan yang dibuat oleh masing-masing aplikasi. Dalam bertransaksi melalui mediator (pihak ketiga) permasalahan yang sering terjadia adalah mengenai tanggungjawab para pihak apabila terjadi masalah/sengketa. Tujuan penelitian ini adalah untuk mengetahui bagaimana keabsahan perjanjian jual beli yang dilakukan para pihak tanpa bertemu secara langsung agar dapat menentukan tanggungjawab kepada para pihaknya. Hasil dari penelitian ini adalah selama penjual dan pembeli melakukan transaksi jual beli sesuai dengan ketentuan yang diatur dalam aplikasi jual beli maka perjanjian itu adalah sah dan mengikat bagi para pihaknya dengan tidak mengesampingkan peraturan lain yang diatur dalam perundang-undangan yang relevan. Perusahaan e-commerce juga memberikan wadah secara terbuka kepada para pihak yang bersengketa untuk menyelesaikan secara bersama untuk mendapatkan solusi terbaik untuk para pihaknya dengan tidak menutup kemungkinan untuk menyelesaikan sengketa secara litigasi dan non-litigasi untuk menentukan tanggungjawab para pihak sesuai dengan kedudukan dan porsinya. / The development technology has impacted on transactions which now can be done by seller and buyer without meeting in person. The technology development is maximized by e-commerce companies to ease transactions by using application under their terms and conditions. In doing the transactions with third party, problem which can raise lawsuit is about the responsibilities of the third party. This research is conducted to understand legality of business contract which is made without meeting in person, thus the responsibilities of each party decided. The result is, as long as the seller and buyer doing the transactions under the term and conditions of the companies who made the application, the transactions legally bind these parties, without setting aside other regulations. E-commerce companies also allow the conflicted parties to resolute the problems between themselves, however they can also take legal actions to decide the responsibilities of each parties based on their roles.
