Violence is often carried out together with one form of crime, acts of violence can be carried out with violence or threats of violence carried out or what tools are used, each depending on the case that arises. These actions can affect anyone, both men and women, from children to adults, especially if violence occurs within the household, often this act of violence is called a hidden crime. The prosecution of crimes of domestic violence in Indonesia is still too focused on punishing the perpetrators. As a rule of law, of course there is a need for better legal reform in the future to protect the rights of victims of the violence they experience as well as forms of accountability that are more personal and have a direct impact on victims. This legal remedy is known as Restitution. Furthermore, the problem to be discussed in this research is what is the form of legal protection for victims of domestic violence and how is the implementation of restitution for victims of domestic violence based on the laws and regulations in force in Indonesia. Thus, this research’s purpose is to explaining domestic violence in the form of maltreatment of children and the effects of this abuse and countermeasures by various parties in order to develop legal knowledge in the future, in this case the application of the theory of restitution to children as victims of physical violence in the household. Therefore, the author conduct normative-empirical legal research which legal research to see the written law that already exists in Indonesia, as well as to see the practice of virtual influencers that have taken place in the community, both through secondary data in the form of books and journals, also primary data obtained through court ruling. The results of the research then show of form legal protection for victims of domestic violence and how is the implementation of restitution for victims of domestic violence based on the laws and regulations in force in Indonesia. The summary of this research is to shows forms of legal protection for victims of domestic violence and also shows what regulations victims can use to apply for restitution in fulfilling their rights.
