Abstract
Penelitian ini dilakukan untuk mengetahui pemenuhan hak anak yatim piatu
dengan hak anak biasa. Anak yatim piatu di bawah umur yang melakukan
pekerjaan untuk mencukupi kebutuhan hidup merupakan situasi dimana anak
yang kehilangan orang tua melakukan pekerjaan untuk memenuhi kebutuhan
hidup mereka. Metode penelitian dalam penelitian ini menggunakan metode
yuridis normatif – dogmatik yang dimana penelitian ini menggunakan pendekatan
dengan cara menemukan bahan kepustakaan seperti aturan hukum, buku, dan juga
doktrin hukum. Dalam penelitian ini menggunakan pendekatan conceptual
approach dan statue approach. Di Indonesia Peraturan Perundang-undangan
tentang larangan atau pembatasan tenaga kerja anak dalam UU No.13 tahun 2003
tentang Ketenagakerjaan telah ada dan dianggap cukup. Hal ini menarik untuk
diteliti karena terdapat masalah sosial yang telah beredar dikalangan masyarakat.
Pada fenomena pekerja anak, anak yang bekerja tidak selalu berusia 13 (tiga
belas) tahun dan di izin kan oleh Undang – Undang untuk bekerja dengan
memenuhi syarat. Untuk itu dalam kebijaksanaan perlindungan anak dalam
bidang ketenagakerjaan perlu dipikirkan jalan keluarnya dengan membuka
kemungkinan anak dapat dipekerjakan pada pekerjaan yang tidak berbahaya, bagi
jiwa anak, moral, agama baik secara jasmani maupun rohaninya dengan
memenuhi syarat-syarat yang ada pada perjanjian kerja yang berisi perlindungan
hukum. Bagi pengusaha yang akan mempekerjakan anak karena alasan tertentu
wajib memperhatikan ketentuan-ketentuan yang ada pada UU No.13 tahun 2003
tentang Ketenagakerjaan./ This research was conducted to determine the fulfillment of the rights of
orphans with the rights of ordinary children. Underage orphans who work to
make ends meet is a situation where children who have lost their parents work to
make ends meet. The research method in this study uses a normative-dogmatic
juridical method in which this research uses an approach by finding library
materials such as legal rules, books, and also legal doctrines. In this study using
the conceptual approach and statue approach. In Indonesia, laws and regulations
regarding the prohibition or limitation of child labor in Law No. 13 of 2003
concerning Manpower already exist and are considered sufficient. This is
interesting to study because there are social problems that have been circulating
among the community. In the phenomenon of child labour, children who work are
not always 13 (thirteen) years old and are permitted by law to work under certain
conditions. For this reason, in the policy on child protection in the field of
employment, it is necessary to think of a way out by opening the possibility for
children to be employed in jobs that are not dangerous, for the child's soul,
morals, religion, both physically and spiritually by fulfilling the conditions
contained in the work agreement which contains protection. law. Entrepreneurs
who are going to employ children for certain reasons must pay attention to the
provisions contained in Law No. 13 of 2003 concerning Manpower.
