Abstract

Corona virus causes respiratory infections such as flu and has spread throughout Indonesia. The Indonesian government has issued regulations to prevent this pandemic by administering the Covid-19 vaccine as outlined in the certificate. However, the phenomenon of falsification of vaccine certificates has arisen which is detrimental to the state because it prioritizes personal interests. The problems raised in this study are regarding the accountability of participating actors in the criminal act of using the Covid-19 vaccine certificate and how the judge considers in deciding regarding the crime of counterfeiting the Covid-19 vaccine certificate in Decision Number 680/Pid.B/2021/PN Smr. This study aims to make legal discoveries regarding the crime of participation in counterfeiting Covid-19 vaccination certificates, find out what is the legal basis that can be applied to co-perpetrators in falsifying Covid-19 vaccine certificates, and find out how the judge considers in making a decision on a crime falsification of the Covid-19 vaccine certificate in decision Number 680/Pid.B/2021/PN Smr. The type of research used is normative research using secondary data research methods, namely primary, secondary and tertiary legal materials. The conclusion from the results of this study is that the perpetrator is sentenced to imprisonment for 5 (five) months based on the judge's consideration because it has been proven to fulfill the elements of Article 263 paragraph (2) in conjunction with Article 55 paragraph (1) of the Criminal Code in conjunction with Article 56 paragraph (1) and (2).
