Abstract
The times have changed the standardization of human life. Advances in technology, modernization, and globalization have led to patterns of behavior that deviate from laws and norms. One form of such deviation is prostitution. Prostitution can occur in any country, and Indonesia is no exception. The practice of prostitution occurs when a woman sells the services of sexually satisfying men who have paid her. A common factor for people to engage in prostitution is their lack of finances, which leads them to seek income quickly. Difficult job opportunities also seem to support easy work without the need for a college degree and soft skills required by the company. However, prostitution cannot be considered an official and legal job. Prostitution is contrary to the norms of society because it can disturb and cause unrest. Prostitution also contradicts Pancasila as Indonesia’s worldview, which incorporates the norms of law, religion, decency, and propriety. However, existing regulations have not stopped prostitution from taking place. Prostitution is a social problem that is difficult to break the chain because there is no legal regulation that specifically regulates prostitution and can ensnare all parties involved in it, as well as the prosecution which can be said to be still not optimal. The purpose of this research is so that readers can find out the provisions of criminal law that already exist in Indonesia regarding prostitution, and that Indonesia does not yet have legislation that can fairly prosecute all parties in prostitution, which is what Indonesia needs. This normative juridical research is conducted by conducting a literature study, collecting data, then processing it into information. Thus, this research is closely related to the literature because it is only focused on written regulations. The results of this research show that although the practice of prostitution is not justified, Indonesia actually has a large number of comercial sex workers, especially online prostitution in this developing era. As of the time of this research, the practice of prostitution continues unabated.
