Abstract
Surat Edaran Mahkamah Agung Nomor 7 Tahun 2012 Kamar Perdata Umum poin IV memperkuat perlindungan hukum bagi Pemegang Hak Tanggungan. Penelitian ini menggunakan jenis penelitian normatif empiris, bersumber dari data sekunder yang didukung dengan data primer, menggunakan teknik perolehan data studi kepustakaan dan studi lapangan dengan penekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus, yang kemudian diolah menggunakan metode analisis data kualitatif. Dalam penelitian ini analisis Penulis fokus membahas mengenai itikad baik pada jual beli dan hak tanggungan dengan studi Putusan Pengadilan Nomor 627 PK/Pdt/2018, yang mana dalam putusan tersebut pemegang hak tanggungan yang beritikad baik dilindungi meskipun ternyata diketahui bahwa pemberi hak tanggungan bukan orang yang berhak untuk itu. Penulis mengalisa bahwa hakim sudah tepat dalam mengambil putusan ditinjau dari SEMA Nomor 7 Tahun 2012. Bank dalam sengketa ini dapat dinilai sebagai pemegang hak tanggungan yang beritikad baik karena tidak mengetahui adanya tipu daya yang dilakukan debitor untuk mendapatkan objek tersebut. Adapun dengan tidak dibatalkannya akta jual beli yang dilakukan dengan tipu daya tetapi tanahnya telah diagunkan oleh pemilik tanah yang baru adalah semua perbuatan hukum setelahnya menjadi sah. Namun dengan demikian pemilik tanah awal tidak mendapatkan perlindungan hukum dan mengalami kerugian. / Supreme Court Circular Number 7 of 2012 in the General Civil Chamber, point IV, strengthens legal protection for the Mortgage Holder. This research uses a normative empirical research type, sourced from secondary data supported by primary data, using data acquisition techniques of literature review and field study with a legal approach, conceptual approach, and case approach, which are then processed using qualitative data analysis methods. In this research, the author's analysis focuses on good faith in buying and selling and mortgages with a study of Decision Number 627 PK/Pdt/2018 of the Court, in which the good faith mortgage holder is protected even though it is known that the mortgage giver is not the rightful person. The author analyze that the judges made the right decision based on Supreme Court Circular Number 7 of 2012. In this dispute, the bank can be considered a good faith mortgage holder because they were unaware of the deception committed by the debtor to obtain the object. Therefore, the sale and purchase agreement, which was made through deception but the land has been mortgaged by a new owner, remains valid. However, as a result, the original landowner does not receive legal protection and suffers losses.
