Abstract

Merek merupakan salah satu bagian dari Hak Kekayaan Intelektual. Di dalam Hak Kekayaan Intelektual terdapat hak khusus yang disebut dengan hak ekonomi dan merek tergolong kedalam hak ekonomi tersebut. Merek merupakan benda maka dapat dialihkan sesuai Pasal 41 UU Merek, Oleh sebab itu tanggung jawab notaris diperlukan dalam pembuatan akta, khususnya akta hibah. Penelitian ini akan mengkaji Tanggung Jawab Notaris Dalam Pengalihan Hak Atas Merek Berdasarkan Akta Hibah Penelitian ini juga dilakukan Untuk menganalisis dan memahami serta memberikan tanggung jawab Notaris dalam pengalihan Hak Atas Merek berdasarkan Akta Hibah dan peralihan Merek berdasarkan Undang-Undang Nomor 20 Tahun 2016 Tentang Merek, Penelitian ini menggunakan metode analisis data kualitatif yang didasarkan pada pendekatan undang-undang yang mengacu pada undang-undang yang mengacu UUJN, UU Merek dan peraturan terkait di Indonesia. Dengan menganalisis kasus tersebut, penelitian ini menyimpulkan bahwa peran notaris dalam pembuatan akta peralihan tidak berpihak kepada salah satu pihak yang menghadap dalam pembuatan akta partij sehingga ketidak-berpihakan ini diatur dalam Pasal 16 ayat (1) huruf a Undang-undang Nomor 3O Tahun 2OO4 tentang Jabatan Notaris. Prinsipnya Notaris menempatkan diri sebagai pihak yang berada ditengah-tengah, dan tidak ikut campur atas keinginan salah satu pihak sehingga notaris dalam hal ini merupakan pihak yang mandiri dan tidak dipengaruhi oleh pihak lain dan Pasal 3 UU Merek, merek dapat beralih atas menurut prosedur dan peristiwa hukum yang terjadi dalam UU Merek Dan Indikasi Geografis, mengatur mengenai tata cara pengalihan hak atas merek terdaftar, sebagaimana dinyatakan pada Pasal 41 ayat (2) Pengalihan Hak atas Merek terdaftar oleh Pemilik Merek yang memiliki lebih dari satu Merek terdaftar yang mempunyai persamaan pada pokoknya atau keseluruhannya untuk barang dan/atau jasa yang sejenis hanya dapat dilakukan jika semua Merek terdaftar tersebut dialihkan kepada pihak yang sama, atau permohonan yang dimiliki oleh pihak yang sama saat peristiwa hukum terjadi. / Trademark is a part of Intellectual Property Rights. Within Intellectual Property Rights there are special rights called economic rights and brands are included in these economic rights. A mark is an object, so it can be transferred in accordance with Article 41 of the Trademark Law. Therefore, the responsibility of a notary is required in making deeds, especially grant deeds. This research will examine the responsibilities of a notary in transferring rights to a trademark based on a grant deed. This study uses a qualitative data analysis method which is based on a legal approach that refers to laws that refer to UUJN, Trademark Law and related regulations in Indonesia. By analyzing this case, this study concludes that the role of a notary in making a transfer deed is not in favor of one of the parties facing the making of a partij deed so that this impartiality is regulated in Article 16 paragraph (1) letter a of Law Number 3O of 2004 concerning Notary Office. In principle, the Notary places himself as a party in the middle, and does not interfere with the wishes of one of the parties so that the Notary in this case is an independent party and is not influenced by other parties and Article 3 of the Trademark Law, marks can switch over according to procedures and events. the law that occurs in the Trademark and Geographical Indication Law, regulates the procedure for transferring rights to a registered mark, as stated in Article 41 paragraph (2) Transfer of Rights to a registered Mark by a Mark Owner who owns more than one registered Mark that is similar in principle or in its entirety for similar goods and/or services can only be carried out if all the registered Marks are transferred to the same party, or the applications are owned by the same party at the time the legal event occurred.
