Abstract
The writing of this scientific work discusses the existence of the right to maternity
leave for male workers according to Law No. 13 of 2003 concerning Manpower.
Where is still the lack of rules or provisions regarding the rights of wives to give
birth to male workers in the Manpower Law. It should be the number of days of
leave due to wife giving birth for male workers should be the same. between civil
servants and private employees is the same. Objective This study aims to determine
how the existence of maternity leave rights for male workers according to Law No.
13/2003 on Manpower. leave due to wife giving birth for male workers according
to Law No. 13 of 2003 concerning Manpower. And why male workers must get
leave when their wives give birth. gives birth. This research method uses normative
research with normative research with the type of statutory approach and library
materials. In Indonesia itself, there is no special rules governing the regulation of
maternity leave rights for male workers. for male workers. The general regulation
regulates regarding the regulation of maternity leave rights is contained in the
Manpower Law, which is stated in Article 93 paragraph 4 letter e. Manpower Law

birth for male workers who need time, namely preparation before and preparation
after childbirth, requires care and affection. preparation before and after childbirth
