Sengketa hukum mengakibatkan munculnya konflik agraria seperti pada Putusan Nomor 60/Pdt/2019/PT.BTN yang dikaji oleh penulis sengketa tanah oleh PT. Cihuni Mas sebagai Penggugat dengan Direktur Jenderal Sumber Daya Air Kementerian Pekerjaan Umum sebagai Tergugat dan Kantor Pertanahan Kabupaten Tangerang Turut Tergugat. Tujuan penelitian untuk memperdalam dan memperluas pengetahuan kepemilikan situ oleh badan hukum serta memecahkan persoalan hukum mengenai Pertimbangan hukum dan amar putusan majelis hakim dalam perkara nomor 60/PDT/2019/PT.BTN ditinjau dari UU Sumber Daya Air dan Perpu No. 2 Tahun 2022. Jenis enelitian ini menggunakan hukum normatif empiris, pengumpulan data dilakukan dengan menggunakan pendekatan Perundang-undangan dan juga pendekatan kasus yaitu dengan mewawancarai langsung nara sumber. Dari penelitian tersebut dapat disimpulkan Pasal 7 UU Sumber Daya Air mengatur bahwa Sumber Daya Air tidak dapat dimiliki dan/atau dikuasai oleh perseorangan, kelompok masyarakat, atau badan usaha. Lebih lanjut Permen ATR No. 30 Tahun 2019 yang mengatur bahwa sertifikat hak atas tanah untuk SDEW hanya untuk diberikan kepada pemerintah atau pemerintah daerah. / Legal disputes resulted in the emergence of agrarian conflicts, such as in Decision Number 60/Pdt/2019/PT.BTN, which was reviewed by the author of the land dispute, PT. Cihuni Mas as the plaintiff, the Director General of Water Resources of the Ministry of Public Works as the defendant, and the Tangerang District Land Office as the Defendant. The aim of the research is to deepen and broaden knowledge of lake ownership by legal entities and to solve legal issues regarding legal considerations and the verdict of the panel of judges in case number 60/PDT/2019/PT.BTN in terms of the Water Resources Law and Perpu No. 2 of 2022. This type of research uses empirical normative law; data collection is carried out using a statutory approach and also a case approach, namely by interviewing informants directly. From this research, it can be concluded that Article 7 of the Water Resources Law stipulates that Water Resources cannot be owned and/or controlled by individuals, community groups, or business entities.
