Abstract
As a country that upholds the rule of law and needs to gradually increase economic growth in order to achieve the vision of Golden Indonesia 2045, the incumbent government needs to foster the confidence of business actors to improve performance and investment within the country. However, it must be acknowledged that currently one the biggest obstacle in achieving the country’s vision is corruption—one which is carried out by government officials or state organizers and involving business actors as private parties. This research studies of a corruption case involving a chairman of DPD RI by business actors pertaining availability of sugar supply for Padang, West Sumatera. The government’s role, which cannot be replaced by anyone else, is to create legal certainty and justice for the people, including the business actors who are involved in corruption cases. One legal product that can provide guarantee for legal certainty is the court’s verdict by judges. In this regard, the application of law by Public Prosecutors and the Panel of Judges in corruption cases needs to be done carefully, accurately and in accordance with legal principles that support the national vision in order to provide a fair legal impact for the people, especially the business community. Business actors and government officials or state organizers involved in corruption must be eradicated, but it is essential for the government to pay close attention to the application of law in the realm of justice system to ensure legal certainty so that economic growth can be carried out optimally.
