Abstract

Hak cipta dapat memberikan perlindungan hukum pada ciptaan tersebut dan menjamin hak-hak dari pencipta tidak dilanggar. Namun pada faktanya lagu sering menjadi sasaran plagiarisme atau pembajakan, seperti menyediakan tautan unduhan di situs web yang tidak berlisensi, berdampak pada pemilik lagu tidak mendapatkan royalti. Tesis ini menggunakan jenis penelitian yuridis normatif, dengan pendekatan penelitian berupa Pendekatan Perundang-Undangan atau disebut juga Statute Approach. Studi dokumen kualitatif tersebut menggunakan data sekunder yang berasal dari kepustakaan. Hasil dari penelitian ini, bahwa Intellectual property rights atau Hak Atas Kekayaan Intelektual memiliki ciri khas yakni bernilai komersial dan merupakan hak pribadi yang dapat dilisensikan dan merupakan hak monopoli guna mencegah orang lain menggunakannya secara tanpa izin. Dengan adanya perjanjian lisensi, perluasan bisnis dapat dilakukan secara efektif tanpa takut terjadi pelanggaran. Lisensi dituangkan dalam bentuk perjanjian yang berisikan kesepakatan para pihak. Dengan telah di dirikannya beberapa LMK yang beroperasi dengan izin Menteri Hukum dan HAM, maka para pemegang Hak Cipta dapat membuat perjanjian lisensi dengan menggunakan Akta Otentik oleh Notaris. / Copyright can provide legal protection for the work and guarantee that the rights of the creator are not violated. But in fact, songs are often the target of plagiarism or piracy, such as providing download links on unlicensed websites, resulting in the song owner not getting royalties. This thesis uses a type of normative juridical research, with a research approach in the form of the Legislative Approach or also called the Statute Approach. The qualitative document study uses secondary data from the literature. The results of this study, that intellectual property rights or intellectual property rights have a characteristic that is commercially valuable and is a personal right that can be licensed and is a monopoly right to prevent other people from using it without permission. With a license agreement, business expansion can be carried out effectively without fear of violations. The license is stated in the form of an agreement containing the agreement of the parties. With several LMKs having been established which operate with the permission of the Minister of Law and Human Rights, Copyright holders can enter into a license agreement using an Authentic Deed by a Notary.
