Pendaftaran merek sangat penting untuk melindungi entitas bisnis dan memastikan perdagangan yang adil. Kontroversi seputar pendaftaran merek Citayam Fashion Week (CFW) menjadi perhatian public juga pemerintah. Penelitian ini menganalisa kedudukan hukum pemberian hak merek dagang untuk CFW dalam sistem hukum Indonesia dan sejauh mana perlindungannya. Studi ini menggunakan pendekatan empiris normatif, mempelajari hukum dan aturan secara praktis. Hasil penelitian menunjukkan bahwa hak merek CFW berpotensi dilindungi berdasarkan prinsip ‘first to file’ dan ‘first to use’. Pendaftaran merek akan mendorong kreativitas dan mencegah penggunaan yang melanggar hukum. Keterlibatan masyarakat membuat Direktorat Jenderal Kekayaan Intelektual (DJKI) harus memproses aplikasi dengan itikad baik yang tinggi. DJKI juga harus mempertimbangkan baik prinsip ‘first to file’ maupun prinsip itikad baik untuk memastikan proses pengambilan keputusan yang adil. The controversy surrounding the registration of the Citayam Fashion Week (CFW) brand has caught the attention of both the public and the government. This research analyzes the legal position of granting trademark rights to CFW within Indonesia's legal system and the extent of its protection. The study adopts a normative empirical approach, examining laws and regulations practically. The research findings indicate that CFW trademark rights could potentially be protected under the principles of 'first to file' and 'first to use'. Registering the trademark would encourage creativity and prevent unlawful usage. Due to community involvement, the Directorate General of Intellectual Property (DGIP) must process the application with the utmost good faith. The DGIP should also consider both the 'first to file' principle and the principle of good faith to ensure a fair decision-making process. Brand registration is highly essential for safeguarding business interests and preventing unfair trade practices.
