Abstract
Rumah adalah salah satu kebutuhan pokok atau primer dari hajat hidup manusia selain Sandang dan Pangan. Jika dilihat dari pertumbuhan penduduk yang terus meningkat, maka hal tersebut juga berdampak terhadap kebutuhan terhadap rumah
yang bertambah. Akibat dari kebutuhan akan tempat tinggal atau rumah tersebut hal ini membuat banyak perusahaan pengembang perumahan bermunculan. Dalam hal pemasaran dan penjualan yang dilakukan oleh pengembang mekanisme
pemasaran dan penjualan dilakukan sebelum rumah tersebut selesai pembangunannya, mekanisme penjualan seperti ini dilakukan dengan cara pembeli atau konsumen melakukan pemesanan terhadap rumah yang akan dibeli, dimana proses ini akan dituangkan didalam perikatan pendahuluan atau lebih dikenal dengan perjanjian pengikatan jual beli (PPJB). resiko yang dapat terjadi dan merugikan konsumen utamanya bagi yang telah lunas dan mengusai objek jual beli dengan mekanisme penjualan menggunakan PPJB adalah saat Perusahaan
Pengembang dinyatakan Pailit. Dimana dalam kepailitan status rumah yang belum dilakukan peralihan hak kepemilikan akan menjadi boedel pailit. Lalu bagaimana kedudukan hukum dan perlindungan hukum bagi Konsumen yang telah lunas serta
menguasai objek jual beli terhadap Perusahaan Pengembang yang pailit. didalam Penelitian ini mengkaji dan menganalisa dengan menggunakan metode penelitian yuridis normatif. Bahwa terhadap kedudukan hukum dan perlindungan hukum bagi Konsumen yang telah lunas serta menguasai objek jual beli UU kepailitan menjamin dengan memberikan pengakuan kedudukan hukum sebagi kreditur konkuren. / Home is one of the basic or primary needs of human life apart from clothing and food. When viewed from the increasing population growth, it also has an impact on the increasing need for housing. As a result of the need for a place to live or a house, this has made many housing Developer companies appear. In terms of
marketing and sales carried out by the developer, the marketing and sales mechanism is carried out before the house is completed, This kind of sales mechanism is carried out by means of buyers or consumers placing an order for
the house to be purchased, where this process will be outlined in a preliminary agreement or better known as a perjanjian pengikatan jual beli (PPJB). The risks that can occur and harm consumers, especially for those who have fully paid and control the object of sale and purchase with a sales mechanism using PPJB are Developer Company declared Insolvent. Where in Insolvent the status of a house that has not yet transferred ownership rights will become Insolvent boedel. Then how is the legal standing and legal protection for consumers who have fully paid and control the object of sale and purchase against the insolvent Developer Company.This research examines and analyzes the legal standing and legal protection using normative juridical research methods. The Bankruptcy Law ensures that consumers who have fully paid and control the object of sale and
purchase are protected by the law by recognizing as concurrent creditors.
