Abstract
Sertipikat merupakan produk hukum pendaftaran tanah yang diterbitkan oleh Pejabat yang berwenang sebagai bukti kepemilikan yang sah. Pendaftaran tanah bertujuan untuk memberikan kepastian dan perlindungan hukum bagi masyarakat sebagaimana diamanatkan dalam konstitusi dan peraturan perundang-undangan. Sertipikat hak milik yang disebut sebagai hak yang turun temurun, terkuat, dan terpenuh dalam UUPA, nyatanya berpotensi mengalami tumpang tindih dengan sertipikat hak milik maupun dengan jenis hak atas tanah lainnya yang terdaftar atas nama pihak ketiga. Tujuan penelitian ini adalah menganalisis kepastian hukum sertipikat hak milik dan perlindungan hukum yang diberikan kepada pemegang hak atas tanah. Penelitan ini menggunakan metode penelitian yuridis normatif-empiris yang dijelaskan secara deskriptif analitis. Data yang digunakan dalam penelitian ini adalah data sekunder yang didapatkan melalui studi kepustakaan. Penelitian ini menggunakan pendekatan perundang-undangan , pendekatan kasus, dan pendekatan konseptual. Hasil Penelitian ini menunjukkan bahwa Pemerintah tidak memberikan kepastian hukum mutlak kepada pemegang hak atas tanah, dengan pembatasan bahwa Pemerintah menjamin kebenaran akan data fisik dan yuridis dalam sertipikat adalah benar sepanjang tidak dibuktikan sebaliknya, sehingga masyarakat diberikan hak untuk mengajukan pembatalan sertipikat hak atas tanah yang mengandung cacat administratif dan/atau cacat yuridis, baik melalui upaya administratif maupun upaya peradilan Penyelesaian sengketa yang dilakukan pemerintah memberikan perlindungan preventif dan/atau represif kepada pemegang hak atas tanah. / A Certificate is a legal document of land registration issued by an authorized official as proof of legitimate ownership. Land registration aims to provide legal certainty and protection for the society as mandated in the constitution and laws. The certificate of ownership, referred to as an hereditary, strongest, and fullest right in the UUPA (Land Law), in reality, has the potential to overlap with certificates of ownership or other types of land rights registered in the name of third parties. The purpose of this research is to analyze the legal certainty of the certificate of ownership and the legal protection provided to land rights holders. This study uses a normative-empirical juridical research method which is explained in a descriptive-analytical manner. The data used in this research are secondary data obtained through literature studies. This research uses legislative approaches, case approaches, and conceptual approaches. The results of this research indicate that the government does not provide absolute legal certainty to land rights holders, with the limitation that the government guarantees the accuracy of physical and juridical data in the certificate as long as it is not proven otherwise. Therefore, the society given the right to file for the annulment of land ownership certificates containing administrative and/or juridical defects, either through administrative efforts or judicial efforts. Dispute resolution conducted by the government provides preventive and/or repressive protection to land rights holders.
